    Sorry - was just elated that the speech had the desired effect!!

    I gave them the full "I must advise you that I am recording this conversation" and "I have repeatedly requested that all future correspondence is undertaken in writing only" and in response to their 'did I think I could just confirm my details for security purposes'... "I think not".

    I requested their full name and that of their manager as I would be reporting them to the relevant authorities for all the reasons stated in my letter dated blah, blah, blah ........ and the line was dead!!

    Small victory in the overall battle, but god it was good !! :beer:

    Round 2 begins today - my letter was not confirmed as signed for yesterday, so i need to check it again today. Does anyone know if the 12 days begins from the date the letter is signed for, or is it 12+2 from the date I posted it?

    If you can track when they receive the letter then it's 12+2 days from then.... 12 for them to sort out a reply and two for the reply to get to you

    Been ill for a while so need to catch up on whats going on with various letters I have sent out.

    Capital One - They had decided not to be helpful after all and continued to harass me four times a day by telephone. I sent them the harassment letter and they paid no notice to it whatsoever. They appear to enjoy talking to me so keep on phoning. My letter to them was dated 25th August and warned them not to harass me or I would report them etc, and also requested a copy of my CCA (I enclosed £1 p/order). They wrote on 2nd September stating that as my letter was not signed, for security purposes they could not review the details of my letter. Another thread on here warns you not to sgn these letters as they could 'rob' the signature for a cut and paste job on a CCA. I am continuing to pay the token monthly payment as calculated by the CAB and it will be due again in a weeks time.

    1st Credit - I wrote to them on 25th August requesting a full statement of account together with copy CCA. They replied on 27th August with a statement of account, and confirmed that the CCA had been requested and would follow as soon as it is received. To date, no sign of it, or any further correspondence.

    MBNA - I wrote on 25th August requesting written confirmation of why they could not assist and were trying to force me into an 'arrangement'. (You may remember they verbally quoted OCC (US) regulations as being the reason they were unable to accommodate my temporary request), and for good measure I requested copy CCA. They replied on 7th September enclosing a copy of CCA - I think I got this from an internet application - which shows my name and address with a tick box option in place of a signature. I am not certain what passes for a satisfactory CCA so if someone could assist me with this please?? They have not responded to my request for written confirmation of why they cannot help - and the phone calls have started back up again.

    Sorry for the lengthy ramblings but I need to get back on track with these things now I am feeling better.

  • Sounds like you can report Capital One to the FO then if they repeatedly phone you after you have told them you do not wish to be phoned. They may get a fine or get their licence removed and they won't like that much.

  • Another fact Michael found out was that debt collection agencies buy debts at an extremely low cost. “I was informed that the £2000 debt that I owed had probably been purchased for around £300 or even as low as £120.” Debt agencies buy debts for around sixteen pence in the pound but they can be purchased for as low as six pence in the pound. They will then pursue debtors not for the amount that they purchased the debt for but for the full amount.     Hiya, first of all glad that you managed to sort this out so far and that you no longer feel scared by their calls.

    But regarding the above, how does one become a Debt Collection Agency ? It sounds like a sure way to make money and lots of it ? And why would a bank or credit card company sell the debt to them for so little while at the same time not accepting reduced payments which amount to more than that ????

    You are stating the absolute obvious - we are all looking for other ways of buying time due to difficulties we're having. For many of us we're not looking to actually avoid paying the debt, more looking for a way of getting the banks off our backs so we can pay as an when we can manage.

    1. Grammatical error, this should read "think you should be moving towards paying them what(or that which) you borrowed from them"

    2. More to the point, very few of us are trying to avoid paying what we owe. Many of us are experiencing financial difficulties due to illness, redundancy, relationship breakdown, the birth of a child, the current economic climate which has resulted in pay freezes and\or reduced working hours. The harrassment tactics used by debt collection agencies can have a very adverse effect on people's physical and mental health. If a SOA clearly demonstrates that there are no additional monies to increase repayments no amount of rude and threatening phone calls will alter this fact.
