You'll find what they say in letters will be very different to what they say over the phone... just for a laugh (and seeing as you are mailing MBNA anyway) why not ask them for a copy of your CCA? You never know, they may not be able to produce it
Have a shifty at what happened when I did that....
You'll find the letter you will need to send in post 20, just delete what you don't need

Your earlier thread makes very pleasing reading!! You mention in it the 12 day deadline for return of a copy CCA, but then you mention that you were 21 days away from the debt been unenforceable. Is is automatically 21 days after the 12 day deadline has expired? Sorry if I am missing something but I think I could use this advice. PS: Were you able to reclaim the money already paid??0 -

There is a 12 working days (+ 2 for postage either side) deadline for them to return a CCA to you, after that they are in breach of the CCA.
If they still haven't produced one after 31 days (unsure wether working or calendar) then the debt in unenforcable and you can stop payments. Edit :: I don't think this step exists anymore, please check the thread
And no, I never got my money back. Just enjoyed being debt free and left it at that...

Edit :: I don't think the 31 day deadline exists anymore, the debt is now unenforcable after 12+2 days ???? please check the thread link i gave you for more up to date information

Hi guys. First post. Just wanted to know if anyone gets harassed by Santander Cards? I do. I recieve at least 5 calls a day from them, all leaving the same voice message read from their cue cards.
The reason being is because I refuse to set up a direct debit with them and prefer to pay them manually over the phone. For some odd reason they HAVE to set up the direct debit date on the 20th of every month (I'm paid on the 25th) and they can't change it? Would all these calls per day class as harrassment?0 -

I reported the dozy %%$$'s to the Information commissioners office for breach of data protection- after numerous requests for a copy of a CCA (they kept sending all sorts of answers trying to make out they didn't understand the question) they then sent me copies of someone else's credit card statements. MBNA are the most aggressive, lying cheats I've ever come across frankly-enough said!now debt free and determined to maintain good spending habits and build savings0 -

Morning DFWs.
Its a lovely morning here - fresh from my victorious speech on a call yesterday as instructed by OP, the MBNA / Global Vantedge cowards have fled with fleas in their ears.
I'm sure it will only be a temporary stand-off, but it sure feels good this morning !! Will check Royal Mail to make sure letter signed for later on.

Sorry - was just elated that the speech had the desired effect!!
I gave them the full "I must advise you that I am recording this conversation" and "I have repeatedly requested that all future correspondence is undertaken in writing only" and in response to their 'did I think I could just confirm my details for security purposes'... "I think not".
I requested their full name and that of their manager as I would be reporting them to the relevant authorities for all the reasons stated in my letter dated blah, blah, blah ........ and the line was dead!!
Small victory in the overall battle, but god it was good !! :beer:
Round 2 begins today - my letter was not confirmed as signed for yesterday, so i need to check it again today. Does anyone know if the 12 days begins from the date the letter is signed for, or is it 12+2 from the date I posted it?
