Incesticde - thanks for the template letter - i'll type it up and get it in the post straight away. Should I send one each to MBNA and Global Vantage? It is Global that we are getting the hassle from - but MBNA that are telling us about the US laws restricting them from helping us. I suppose I should ask for confirmation of this in writing from them as so far, they have only confirmed verbally about the OCC regs.
dfh - thanks for the leaflet which I have found very informative - I can hardly wait for Global to call me back now!!
That's a switch . Looking forward to a call from a collections agency lol. But really,I do hope this gets sorted out for you.0 -
I have to say, I did enjoy talking on the phone to the last lot that chased me - I ran rings around them quoting legislation and the law about CCA's and the dispute that meant it shouldn't have been sold on to them. I think they actually hung up on me once! A far cry from them making me feel suicidal like they used to, and a testament to how much difference this site makes.Unless I say otherwise 'you' means the general you not you specifically.0

Glad you found my advice to be of some use, I would send the letter to both companies if they are both phoning you.
You'll find what they say in letters will be very different to what they say over the phone... just for a laugh (and seeing as you are mailing MBNA anyway) why not ask them for a copy of your CCA? You never know, they may not be able to produce it
Have a shifty at what happened when I did that....

You'll find the letter you will need to send in post 20, just delete what you don't need
Good luck with it! Keep in touch and let us know how you get along"I don't want to sound cold and un-caring, but I am those things so that's the way it comes out" - Bill Hicks0 -
so you think a company who charge loan shark interest & charges , a company who use illegal harassment & scare tactics , you think i am wrong to exersice my legal rights ? , they openly run roughshod over OFT guidlines , breach the communications act , they ignore recordered delivery letters stating peoples legal rights need i spare these crooks any sympathy i think not .You seem to be a compo person, think you should be moving towards paying them which you lent from them.0 -

I am generally against people using "unenforcibility" but in your case, you will be perfectly justified given how unreasonable the company has been with you.So if you do decide to go that route,I hope you are successful !0 -

If you choose to use them, you should pay them as agreed.0 -
You don't get to 'choose' a debt collection agency.Unless I say otherwise 'you' means the general you not you specifically.0

This is really spooky... I posted a comment in this thread earler today and stated that I might need the template letter posted by Incestucide.
Barclaycard had the nerve to ring me tonight at 8.40pm !!!
Luckily for them, my (female) partner answered the phone, they then had the stupidity to ask if it was me who answered the phone! My partner "Does it really sound like Mr. ****?!!!!" to which said "I suppose not" and then they hung up!
I am now going to use Incesticide's template and fire off a strongly worded complaint to Barclaycard. The fool who phoned me tonight is going to have a crap life from now on.....!:mad:DFW'er - Lightbulb moment : 31st July 2009 - £18,499
28th October 2019 - £13,505 - 27% paid off.

Bl**dy typical. Chrisblue1962 gets an immediate call - I am sat here fired up with my speech - and Global/MBNA don't even have the courtesy to bother me on a Saturday evening. I am in a right mind to compain....0
