get a cheap second hand "locked to 3" handset on ebay to see out the remainder of your contract, then upgrade or move network

  • i have a HTC hero that is about a month old.....I have found out that the wi.fi on it doesn't work.

The company that i bought it from insists that it goes back to HTC for a repair....where do i stand on getting a new one or cancelling the contract

  • In a similar situation, my handset died today - 30 days before my upgrade is due. I called them and they offered me a new handset and early upgrade for £160.00.

If I wait 30 days I can have the handset free.

In the meantime I have a !!!!!!ed handset and cant use the month I have already paid for... grrr!!

:rotfl:Three are not very customer savvy, the sensible thing to do would have been to upgrade me early, and keep my custom for another 12 months.

Now in 30 days time I will tell them to KMA and get a contract with 02 or Voda.

cancel it now, if you cant use it you have nothing to loose,
then see if they come up with an offer. you will find you need to give notice anyway

Under the Sale of Goods Act the retailer has a responsibility to offer/arrange the repair no matter what, under warranty, but in reality all they'll do is forward it to HTC on your behalf so it's generally easier and faster to cut out the middleman and try to get it to HTC yourself.

If it's less than 28 days old, with most places you can insist on a replacement rather than a repair. You could also argue the Sale of Goods Act means that it's not fit for purpose or not as advertised and therefore they need to replace it.

    Good luck,
