Not happy with item - not sure what to do

I bought a Kipling bag from Ebay on Sunday, which arrived today. It was described as "New - with tags".

Well - it has the tags alright, but I not convinced it is new, for the following reasons:-

a) One of the zips was broken. No big deal, my OH fixed it and it is now fine.

b) It smells like it's been in the washing machine, and a bit soft/floppy compared to my other Kipling bags. I had a Kipling bag before which was washed and it felt the same.

I am really not happy with it, but I'm assuming it will be my word against hers, if she maintains it is new. I'm kicking myself now for fixing the zip, because otherwise I assume it would count as being faulty!

Is there any point in contacting the seller? If so, what do I say? Or should I just put it down to experience and see if I can live with the floppy bag?

    Send a message to the seller saying that you have recieved the bag, and you don't think it's new as they described, and what you said in the post below.

    Some sellers list stuff as "new" when it is in fact used but "like new", which is really annoying.

    They may offer a refund if you send the bag back (make sure you send it trackable) or a partial refund. If they ignore you, or send a useless message back, then open an "item not as described" dispute, and Paypal will force them to refund you if you send the bag back.

    She has asked me to send the bag back, then she says she will refund me. I am reluctant to send it before she does, as I will then not have any proof, if she fails to do it.

    If you send it via trackable means then you will have proof she has received it.

    I'm doing exactly the same thing with a Furla bag I recently purchased. Although the listing stated there was a mark on the bag it didn't mention all the scuff marks and dirty handles which were on the light coloured bag. My seller has agreed to refund if I send the bag back by trackable method.

    Put yourself in the sellers shoes.... would you want to refund something you may never receive back? I quite understand why they would request the return before making the refund - it's very much the norm on ebay.

    If only people were more honest in their listings we wouldn't have any of these problems - yes, I do live in Cloud Cuckoo Land! lol

    I know. I've sold loads of bags that I've used only once or twice - they would easily pass for new, but I'm always honest and say they are used. I had one I had never used, but I put used in the item description then explained it had only been sitting in my house since I bought it!

    Same here... I always quote every minute flaw and couldn't believe the seller would not mention all the scuffs etc on the bag I bought. To be honest I don't think I would have had the cheek to list it. I certainly didn't want my mitts holding on to the dirty handles.

    Don't you just feel so deflated when you open up the parcel to be confronted by something completey different than you were hoping for?! :D

    It looked fine initially although I could smell it straight away, and then I noticed that the zip wouldn't close. I must admit that I am very disappointed.

    I have agreed to send it back and she will "check it over". I'm not sure I like the sound of this, what is there to check? It's not new and I don't want it.

    Should I open up a dispute with Paypal now or wait and see what she says first - anyone?

    Just send it back tracked first, don't open a dispute yet when you have already had sufficient communication from your seller to say they are happy for you to return it for a refund, if and when she receives it back and disputes refunding you, that's when you can open a dispute but until then just co-operate

    Just got this message from the seller:
    Just to keep you informed the bag did not arrive today.
    I have contacted kipling and made arrangements to return bag. Also i have washed a kipling bag to see how it smells/feels .
    So when the original bnwt bag arrives back i will be able to sort it out.

    I haven't posted the bag yet as I won't be able to get to the post office until Monday.

    What is she on about, returning the bag to Kipling? What has that to do with me? I'm concerned now that because I fixed the zip, there won't be any "proof" that the item isn't new. Also when I packed it up to send back, the washing powder smell has worn off a bit.

    I'm wondering whether I should just keep it and try to re-sell it (as used, obviously).

    On second thoughts, I think as a matter of principle I should pursue this. Will Paypal find in my favour, do you think? She has already said she will refund me once the bag is returned, so I don't understand all her comments about inspecting the bag, sending it back to Kipling, washing another bag etc.

    Send it tracked. If she doesnt refund in a timely manner open a dispute and enter the tracking number and you should win
