Hi, hope you can help! Hope I'm also on the right board....
I live in a flat for which I pay a monthly fee to a management company.
At the end of 2008 there was a £15.99 short fall and I received a letter telling me to pay that. I phoned up, gave my card details and thought no more. Six weeks later, I received a letter saying I hadn't paid and I would be due a £50 admin fee if I didn't pay within 7 days.
I complained and the Area Manager came to my house to say that they hadn't taken the payment in error, however I would not have to pay the £15.99, as the service we had received had been so poor. I again, didn't give it a second thought.
I have now received another letter asking for the money, including the £50! I emailed the area manager who said he asked for the fee to be revoked, but had no luck, only this was the first time he was telling me this! He is now saying I have to pay the full c£73 and that the only way I can get out of it is to go to court?! Can anyone help with this? Over £15.99, which is no issue at all, it all seems a bit extreme!
Thanks
Malcolm

It's a hard one. Morally you shouldn't have to pay. But the reality is it will come down to your word against the area manager's.
I would put all this in writing, dates, conversations, and send it special delivery to the area manager (so he has to sign for it). Tell him also you will contest this if they take you to court.
CAB can offer you advice as will most good solicitors free for half an hour.0 -
