mobile phone insurance mis-selling
Friend of mine has just tried to claim on her mobile insurance for a lost phone - having gone through all the details the claim was rejected because her son had it. The phone was bought for her son, he is under 18, so can't get it in his own right. My friend bought this over the phone and made it clear that it was for her son but she was still sold the insurance.
Is there anything she can do - she is left with no phone and a long contract to keep paying for

Should have said she (your friend) lost it rather than her son - not meant to give the phone to someone else - contract is in her name.
If she has only been on phone to the insurance firm to get rejected - she might be cheeky and send a letter to the insurance company and say SHE lost the phone and wants to claim. Never know....they may not know (have a record) of her previous attempt to claim.0 -
Your suggesting the commit fraud and a fraud at that which is not exactly hard to detect...
Your best bet is to make a complaint about the miss selling of the Insurance in the first place which could might either win back the premiums you have paid or get the claim settled, write a letter of complaint, they will be duty bound to investigate it and get back to you within certain time scales. If you get no satisfaction your options would be to ask for a copy of the phone call under the data protection laws or take the complaint to the ombudsman which will cost the firm £360 whether they win or lose so they often pay up to avoid the costs0
