I think by cancelling the holiday, you have significantly impacted your ability to not refund her half of the money you receive.
She chose not to go on holiday and cancelled. But by you cancelling as well, you also chose (albeit not willingly) to not go on holiday.
You could have gone on holiday, and she would have lost her half, with no right to reclaim (after all, she could always have gone? That's how I believe it would be seen anyway). But by cancelling, it's now a case of two people deciding not to go, and any refund should be shared between the two.
I know this doesn't sound fair, as after all, you weren't the one who initially cancelled, but ultimately, I think this is how it would be perceived if it went as far as small claims court.
As for the dodgy insurance claim.....maybe you should send her the newspaper article about the two british students in Brazil who got locked up for 5 days and are about to be sentenced for insurance fraud......might change her mind!!!
It may not be that simple for the OP to actually go on the holiday, it may have been booked with certain discounts etc for the pair of them, if two don;t go, then the OP may be stung for single person charges and such like. This is something that we don't know.0 -

But presumably if the OP did go on this own then no discount would be forthcoming for the second person. Any single person suppliments etc would not amount to being more than the charge for a whole extra person.
So I don't see any issues with the OP going on the holiday despite it being on his own.
But of course, who wants to go on holiday on their own?!0 -
her friend will only get monies back that was not refunded from the holiday company but i would be really suprised if she managed to make a claim considering its over 5 weeks away. If you have cancelled it, the insurance company contacts the holiday company to find out what date the cancellation happened.
What could the doctor say that the reason someone cant travel in
late september? If she hangs off to nearer the time to get a sick note
there is no way they will pay out0 -

Pleased your happy. I'd make her wait/sweat before you give her the money though!...and let her try claiming on insurance for a holiday that was cancelled! Insurance companies seem to be taking fraudulent claims the whole way legally.0

I'm glad you got something back - but I'm b******* if I'd give her half of it!!! She backed out and as a consequence you lost your money. The refund is only part of what you lost - due to her carryings on -so I'd keep it. And tell her you'll take her to court for the rest of it (won't work but might scare her off ).ELITE 5:2
