Any refund (is that likely at all?) would go back as a credit to your credit card account. Even if your ex-friend had the booking details, they would not be able to get a refund from the Travel Agent.

depending on what type of holiday it was, I probably would have gone without the friend. Nothing wrong with being billy-no-mates for a week or two if its a nice sunny holiday.

If she gets a note to say she is unfit to travel, will you get a full refund, as in on the basis that one person is unfit to travel could the whole holiday be cancelled/reimbursed for the full amount?

I would personally tell her that you would like her to still go on the holiday, and that you are happy to let her have the paperwork to show she is indeed booked on the holiday for which she has paid - maybe she thinks you haven't booked the holiday?

Also if you were to go on holiday and just cancel her proportion would you still get a refund for £200, (1/2 the £400 previously mentioned)

you could explain that if she chooses not to go, then you will try to get someone to take her place and if you do then whatever they pay for the holiday you will pass onto her - less any change of name charges, but if you can't get anyone to fill her space then you can only give her any cancellation reimbursment for her share of the holiday - if any is due.

I really apprechiate all your comments about going alone, but I am not. I have cancelled the holiday.
What I really need to know is:

1. Will any court action she raises against me stand up?
2. The holiday was cancelled today, should I send her the itenery?

I am worried sick about all this.

I would gladly give her a copy of the itinery I would also ask the provider to send you a copy of the the amounts paid and amounts refunded to you, from the refund, deduct your half and what is left over give to her, she shouldn't be entitled to a full refund of her half of the holiday anyway as you won't get the full amount back that you have jointly paid, you will only get a proportion and yes I agree that you shouldn't be out of pocket because she doesn't want to go, therefore deduct your half from what you have paid and give her what is left, if that turns out to be nothing then so be it

I cannot see any court action standing at all, if she paid you in cash and has no receipt from you to prove she gave you this money anyway, she is just desperately trying to find a way of getting her money back and threatening you

So the holiday was £820 (410 each)?

and refund given £400?

so therefore you are £10 out of pocket?

if thats the case I would tell her the holiday was booked for both of you and as "she" was the one that cancelled, leaving you no choice but to cancel the holiday as you were not prepared to travel alone, then She is £410 out of pocket and you are £10 out of pocket as it was not your choice not to travel.

How much money are they giving you back for cancelling the holiday? Is it the £400? As you paid £400 for your holiday you should keep this as it covers your costs.

This means you haven’t lost out on much.

£820 for the holiday

£400 from your friend
£400 back from the company for cancelling your holiday

Leaves you £20 out of pocket

Send her an invoice for the £20 ha ha ha ha ha

as for court action it could work the other way, you could have said you had not received the money as she has no proof other than drawing cash from her bank account which means nothing, so she wont get anywhere with court action unless you have signed a receipt to say you have received the money for the holiday from her.
