Paypal dispute or phone CC company?

I bought a car bumper but the pictures were deceptive. To cut a long story short its in such poor condition its not worth repairing and repainting.
The seller agreed a refund but then left ebay despite having a near perfect rating with around 400 feedbacks.
I decided not to send it back because for all I know hes gone awol and I might never get the refund so i started the paypal dispute.
Problem is paypal will force me to send the bumper back, but at that point will I know if he even has the money in his account to issue the refund? Will paypal only ask me to send it back if he has the money?
Im tempted to just complain to the credit card company but will they be interested?

I believe you cant use the claim back on a credit card for items purchased using paypal, even though the money came from your CC. The CC to paypal transaction was ok.0

The paypal claim seems fruitless because wont paypal instruct me to return the item without securing the refund money?
Paypal is a joke these days. Last dispute they forced me to send the item back for a refurn even though my whole claim was regarding a partial refund as I had used the item.
This is only my 3rd dispute in about 8 years... and Ive never had any luck with them0 -
Send it back by trackable method, and paypal will claw the money from his account regardless of whether it's their or not. It's then THEIR responsibility to pursue this guy for the money.Should've = Should HAVE (not 'of')

As PS says. It does not matter wether the money is in his PP account. If you bought it via ebay PP will refund you no matter whats in his account0

When a PayPal dispute is opened, PayPal will put a hold on the full amount from seller's account. If seller doesn't have the necessary fund in their account, PayPal will put them in the negative anyway and chase for their money.
The most important thing is that you send the item back via Registered post. PayPal will need tracking information to confirm that you have indeed sent the item back. You will probably lose the dispute otherwise.

Yes indeed. And general opinion is that Recorded is frequently NOT signed for, meaning no acceptable tracking number.My TV is broken!

Ive had people put in disputes on me in the past.
When my account went into the negative I assumed that the buyer didnt get his money until I transfered the money.
But what youre all saying is paypal take the money out of their pockets to give to the buyer?
In that case I guess Im ok.

At least you used "I believe" as a disclaimer, but what "you believe" is wrong.
Essentially you can make either a Paypal claim or a CC chargeback (dependent on minimum claim amounts set by your card provider, if any). If you make a Paypal claim and it fails and then you make a CC claim, basically PP will be...pretty !!!!ed off. Read their terms and conditions for more details.0
