Bought 2nd Hand Car - Problems!!

Morning All
I bought a 2nd hand car from a Main Dealer a week ago. Yesterday I noticed that the sun visor will not stay up, and it is apparent that something has been 'bodged' as there is a visible bit of wood sticking out where it connects to the car frame!!
Hopefully that is the only problem I will have - the car drives fine.
Since I've bought the car though a couple of people have told me that it should have had a full years MOT - it doesn't, runs out in Oct 09.
I'm planning to take the car for an MOT this week, am I right in thinking that if the car fails, the dealer has sold me an unroadworthy car so I can get a full refund - as long as I do it within 30 days of purchase??
Is that my Trading Standards statutory right thing??
I honestly think that the car will pass - it has a fsh and the hpi check came back clear, I'm just annoyed about the visor thing, the dealer must have known about it so in my book it was deceitful not too mention it - just makes me wonder about any other 'hidden' problems!!

  • no a dealer doesnt have to put a years mot on that

    as for the visor ask him to fix it (he may way say you broke it) or easier goto a scrappy and get the bit yourself

    i dont think you will have much luck getting him to do mot repairs, if it was that important to you you should of done it as a condition of sale

    It probably would have had a full MOT if you had insisted upon it as part of the deal.


    You cannot get a refund just because a car fails an MOT, it could fail on one light bulb not working.
  • also it is possible that the dealer didnt know about the visor, its not something i really check that often when looking at a car

    how old is the car? what dealer is it? i know vauxhall main dealers give 12 months mot and and network q warranty for instance
  • The car is a 52 plate Mazda 6 bought from a dealer in Barnsley. I'm new to this car buying business and didn't realise that I could insist on a full year's MOT. I only know enough to know that it needs one!!
    So, if it fails the MOT on something major, don't I have any Statutory rights thing with the dealer?? Obviously if it failed on a light bulb or something small I wouldn't be too bothered, but what if it was something more serious?? More pennies for me to shell out!! x

    Why not wait and see what, if anything, it fails on.

    Or put it in for an MOT now, to put your mind at rest.

    your getting a bit worked up about nothing george. if you couldnt see the sun visor was broken when you bought it then maybe the dealer didnt know about this either, it could have been the previous owners bodge?
    take it back and ask then nicely to fix it.
    as for the MOT you should have asked for a full years MOT when you bought it, but i wouldnt be expecting your mazda to fail on to much.
    ...work permit granted!

    I echo what everyone else has said. You need to be a bit more "savvy" when it comes to negotiating a car purchase. No respectable dealer would have an issue with giving a full mot with a car purchase, especially if it only had 3 months to run. If it had more you could still insist on it being done at a garage of your choice, at your cost, better in my view than an rac/aa inspection for about the same price. And you can always "re negotiate" the results into the deal.;)
