3 mobile phones

I had a Nokia 6700 delivered from 3 four days ago. I had requested this phone because I had visited a 3 store, and liked the look of it. I opened the phone, and put in my sim card to begin using the phone. What I didn't realise is that all of my contacts would be saved in a different format, and my memory card is not compatible (I currently have a Sony Ericsson).
I phoned 3 to ask for a different phone, as I do not like the 6700, but they will not exchange because I put my sim card in and took a photo.
They quoted their terms and conditions to me. It does say that you should not put your sim in, but how do you see if the phone is any good without testing it?
They have told me that I cannot cancel my contract, and am now tied in for 18 months. I have no cooling off period because I used the phone. Is this legal??
I am even paying an extra £2 per month for the priviledge of having a phone I don't want. They try to trick you on the phone by asking 'Was it easy to set the date?' and ' what was the camera quality like?'. Be careful, as once you answer these questions, you have confirmed that you have used the phone. Even if you don't answer, they threaten that if you have used the phone at all, they will check when it is returned, and will charge you the full cost of the handset.
When I told the lady on the phone that it was immoral, she implied that I was immoral because I did not immediately tell her that I had used the camera (as I knew it was a trick question).
Can anyone help? I am extremely annoyed with 3 (as you can tell!)
H.

Can you not put your new sim into your Sony phone (if its not locked phone) - then transfer your contacts to the Sim Card memory.

Once done, put sim card into the nokia and transfer contacts from sim card memory to phone memory.
  • thats wrong. I am currently having an ongoing issue with my three phone (nokia e71) since i got mine about 4 days ago and the supervisor in the indian call centre told me that if i am not happy, i can return the phone, whether used or not, to the store within 14 days of purchase. I suggest you go to the store and tell them this. Supervisors name is kareem.

Yup under law me thinks 14 days to return an item if purchased via web - if in high street store, then no.
  • Have transferred contacts to sim. Apparently, Sony Ericsson have a different way of storing contacts. In new Nokia phone, they all come up surname first, and I can't change it without editing each contact individually.

That would apply if the phone was unused, and in a resellable condition, as its been used it cant be sold as a 'new' handset if its returned.
why should the network have to lose money due to a buyer changing their mind.
theres a leaflet in every 3 phone saying what you can and cant do if you want to return the phone.

There are STACKS of threads on here saying that if you use the phone they won't take it back. A bit of research before you buy pays dividends. . .

There's an option to switch the order in which the first and last names are displayed.
Go to your Contacts list -> Options menu -> settings -> Name display
  • Tried that, but they are still arranged in last name order! Am now stuck with phone and 18 month contract :(
  • Its a fairly easy problem to sort, the whole name is more than likely saved in the first or last name section, all you need to do is edit the names so that the first name is in the first name section and the surname is in the last name section.

    Shouldn't take you too long
