Item arrive opened and missing - now what/

I sold festival tickets on ebay and sent them on Thursday via registered mail.

I am now being told the items arrived but there was nothing in the envelope as the envelope was opened.

The buyer has now put in a paypal dispute wanting his money back.

But where do I stand as the seller? I dont want to refund them because as far as I am aware I sent the tickets.

I have never heard of this happening to anyone and I am starting to doubt if the buyer is telling the truth or not.

Who will paypal normally side with? Can I make the buyer claim the money back from Royal Mail?

    Hmm, I don't think RM cover for tickets? Someone else will possibly know more.
    Sounds very dodgy to me, and possibly a way to get round the fact that they signed for them, or could be genuine.

    royal mail special delivery covers tickets

    1st, 2nd and recorded don't cover tickets

    I am surprised that the recipient signed for them if the envelope was opened. If the item tracks you might be ok but what if the envelope had been opened?

    This is down to personal honesty at the end of the day.

    Tell the buyer that he will need to report the matter to the police and get a crime number (tampering with registered mail is a very serious offence).

    Tell him that once you have the crime number you can have the tickets marked invalid so the thief cannot use them.

    Then await his response.

    I assume that the OP means SD when he refers to registered as this is what a similar service was originally called.

    I think I would also tell your buyer that you are contacting the promoters to say that the tickets have been stolen so they can be cancelled if you suspect the buyer is being dishonest here.

    i agree with moglex, call there bluff if you think they are lying and tell them you will get the tickets made invalid so they can't be used.
    If they co-operate and you think they are telling the truth then you will need to refund your buyer and make a claim with RM yourself.
    Paypal pretty much side with the buyer.

    Yeah I did indeed use special delivery.

    This is the latest response from the buyer
    no you cant get them reissued. the post office
    have the envelope, the post office investigation
    branch are looking into this!!!!!! i just got off
    phone to the manager of my local depot. she seems
    to think scam also!!!! i want refunding!!!!


    I am really confused. I just spoke to RM and the item has not been collected and nor has any notes been made about this item.

    I am getting really worried that I am going to be out of pocket here due to fraud. I guess I just have to see what paypal decideds. But from what I have read I am going to lose out.

    This is why i hate ebay sometimes.
  • Have you asked RM to inspect the item and confirm that it is in fact in one piece and has not been tampered with?

    I'd ask the buyer for the Phone number of the manager that they were talking to. Just calmly say your the buyer that you need to investigate this matter further. That you are in the process of cancelling the tickets but need confirmation from Royal Mail (and a case number from them) before you are able to look at a refund. Also tell the buyer they need to report this to the police if there the tickets have been stolen before they arrived.

    Then see what his response is
