DSR return rights with ebuyer

My mum bought my dad a new TV as a surprise from ebuyer, but he doesn't actually want it.

ebuyer refuses to pay for return postage as it's not faulty, and they are just returning it under the 7 days DSR due to having changed their mind. They say my mum has to arrange the return herself.

She has called lots and lots of couriers, but none will take it, either due to it being a TV, or due to the returns address being a PO Box.. Seems very odd. The size and weight is not an issue, but they ask what it is, and as soon as they see it's a TV and/or PO Box they refuse to take it.

I originally posted on eBay board seeing as the regulars on there deal with couriers a lot, but they pointed me over here - I didn't even know this board existed!

Any help gratefully received - thank you.

    Well, as long as they've put in their T&Cs that you must pay return post, they are correct that you must. And I'm pretty sure they will have.
    Reason they're refusing is because there's nobody to sign for a PO box, its just mail set aside in the sorting office. Try contacting ebuyer and asking for a returns address that is a physical place. Seems strange that they want you to return to a PO box, I don't think that's quite right somehow.

    You need to contact them and get a RMA number send it to address they give you along with a covering note explaining why you return it, you normally only have 7 days when it arrived to return it unless they extend it and you can only examine goods not use them

    As Henry said if they state in T&C that yoiu have to pay return postage then afraid you will have too

    Thats wrong im afraid.
    You have 7 days to notify of intent to return the item. You do not have to send the item within 7 days.

    Also, regardless of whether the item is received back by the seller, they MUST refund within 30 days of notification of DSR enforecement.

    You are corect regarding postage though. The buyer foots all costs for this.

    Thank you for all the replies. If my mum has to pay return postage, then that's fine. The issue is that because ebuyer won't arrange the return, she has to arrange it herself, but she cannot find anyone that will take a TV to a PO Box. She has literally tried over 50 couriers.

    She has already contacted ebuyer to get the RMA number (nearly 1.5 hours on phone to 0870 number so I'm told). But she can't get the TV back to them.

    Thanks for the physical address, do you think we would be safe to get her to return it to there without ebuyer being funny?

    I used tnt which i payed for via parcel to go i think, the item cost abdout £10 to send to ebuyer, heres a thread i started on the boards about courier companies, it has links to a few websites you could try,

    Ebuyer use an 0871 number,(more expensive than 0870, and from a BT line they cost 10ppm, so for 90 minutes would have cost £9. + 8p connection fee!), for future reference use the "saynoto0870" site to find a geo number, the one listed on there for ebuyer is; -01430 433605

    Thank you for that, very useful! Mum did actually tell me she'd looked on saynoto0870 but I'm not sure what she put in, as she couldn't find anything on there. I'll give her that number now in case she ends up needing to call them again.

    I just put in the number from the ebuyer site I linked to above; - 0871 521 33 00,(without the spaces), and it turned up the 01430 one, hopefully it will work, I never tried it;)

    When companies like Ebuyer issue a RMA they give you an address to use for this.

    If you return something to Ebuyer (or any other similar company) without organising it in advance and getting the RMA agreed you'll cause yourself no end of hassle.

    Also the notice to cancel the contract within 7 days, -for the sale of goods that means 7 WORKING days (MTWTF) from the day of delivery of the goods- must be given in writing, a fax or email or letter, a phone call will not do. Also the notice can be sent on the 7th day, it does not have to be received by the 7th day.
