    The maintenance charge is pre advised so if you keep your statements then look at the back of them.

    EDIT: did you pay in money to cover the charge and the bill payments?

    I think totty paid cash in of £93 on 31st july (or whatever) then called the credit card company and made the £93 payment to them which cleared on 2nd August.

    A charge was due to go out the account on the 3rd, so that charge going out should have created a further £28 overdraft fee.

    However the bank have said that the charge went first, the credit card payment didnt go until after on same day so they can charge a paid item fee on top of another £28 overdraft fee ?

    Well, technically yes, the charge going out would have meant that when the money went out of the account it would have incurred the charge as no money was used to cover the charge going out.
    Standard reclaim me thinks.

    thanks for the advice both but can the bank charge me the £30 odd pound for the card payment when it went threw on the 2nd and there was enough money in the account to cover it as i have had my husbands credit card statement and it says on there that it cleared on the 2nd so should it not just be the £28 fee at the beginning of next month instead of £63....hope this makes sense to you...

    Yes it should as the item that took you back to unauthorised overdraft was their charge so there shouldnt be a transaction fee just the monthly unauth overdraft fee of £28.

    This £63 is coming out beginning of Sept ? I;d get a complaint letter sorted and sent in asking them not to take it and explaining the circumstances and add in about the oft test case and unfair charges.

    thanks for your help have spent most of the morning looking back at all my old statements didnt realise how many charges i have had put on me for the past six years most of them are for unauthorised od and a few return payments it came in at a whooping £3000 can i claim all these back to as it would help me out big time as im so skint at the moment....thanks again for your help...

    The FSA waiver revokes the 6 year limit as from July 27th 2007, which means you can claim any charges from today back to July 27th 2001
