PCN received - Disabled Badge

Hi, i need some advice and was wondering if anyone could help me.
I took my grandad shopping and when i returned to my car I received a pcn for parking on a double yellow line even though the badge was displayed. The reason stated was parking in a restricted street during prescribed hours. When i rang the council the reason they stated was that the badge was half covered, so wasnt clearly displayed. Have i got any grounds to appeal as these are two separate reasons? any advice would be great.

Please read the sticky on the front of this board and follow the instructions. You will need to provide far more information, including a photo of the ticket.0

If the badge wasn't fully displayed (the right way round) then it isn't valid for parking (some people will try and use out of date ones/dodgy ones with details partially hidden).
So probably no get out there.
As sarah says, check the sticky thread as it may be appealable on other grounds.
P.S.
As someone who has had a few problems with disabled badges in the past (mum's got one, as have I), if it's a regular/semi regular thing taking someone who has a BB out in the car, it may be worth using something like a pair of velcro dots (Available in packs from supermarkets as sewing supplies) to make sure the badge doesn't move away from it's visible location when in use (but can still be easily removed when not in use).0 -
Hi, please can someone give me advice - i have recently recieved a parking charge from the above company (Central ticketing) for parking in a disabled bay on a private car park (shopping outlet) which i mistakenly thought was a mother and child space - i do not have a disabled badge. I dont want to pay this £85 as the car park is completely free and i was only there for less than 10 minutes. I've read loads of replies on consumer forums about not having too (and i have a friend who is a private bailiff and says its unlikely that i will be taken to court, the wording on the ticket says they "may" take court action which he says for his company means they dont) but i really cant afford to end up paying X ££'s to this firm. I'm happy to write to them but should i wait until i recieve a first letter or respond to the ticket itself? do i have any defence to this as it was a disabled parking bay?

2) Read all the other parking threads on here - blue badges and disabled bays have no legal standing in private car parks, and Central Ticketing have no authority to fine anybody.
Don't contact them, and don't pay them a penny - ever. It's all a scam.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0 -
Just write in with a copy of both sides of the badge- provided this hasnt happend alot of times before, you have a good chance it wil be cancelled. You are allowed on DYL and SYL for 3 hours with a blue badge- sometiems they slip so they cant be read, but please do write in as you have a good chance of getting it cancelled (depending on the policy of your council).0

is disabled badge valid if stuck on front passenger side window? i know a lot of people place tickets there0

It's valid as long as it's visible and with the correct side (the side with the expiry date and serial number - not the side with your picture) facing up/out.
IIRC you can even put them in the back window if that would make it more visible (IE parking front bumper next to a wall).
The key is (or was last time i checked), that it should be clearly visible, there aren't any requirements for exactly where (unlike things like road tax discs).0 -
My wife got a PCN in similar circumstances when she took her mum shopping. The blue badge slipped down on the dashboard and wasn't fully legible. She wrote in and was asked to provide copies of both sides of her mums blue badge. The PCN was cancelled.
As said before, as long as this is a one off and not happening all the time then the council should cancel the PCN."You should know not to believe everything in media & polls by now !"
