Yeah, i'm 90% certain they would give up before a court date - but it would take over your life for the next 6 - 9 months.

If my phone broke every time I dropped it on the ground I'd have gone through hundreds by now! It's forever dropping out of my pocket and it's always fine.0

I actually think I would get more stressed by not doing anything. It would eat away at me forever if I let them get away with it
I am self employed so time off isnt a worry either0 -

Me too - which is another reason why I am so mad - this phone wasnt dropped, but my own phone gets dropped on a daily basis and I have had it for 18 months now with no problems. The other day I dropped it whilst I was walking along and so kicked it as well, it flew through the air and hit a brick wall opposite me!0 -
But surely the only thing you can get back from cw is the price of the phone plus court costs? i.e £50
you wont be able to get any traveling expenses/postage/dinner etc. if the claim ends up in court?
(NB - very small chance you could also lose aswell! - worth remembering!)
solicitors charge the same price by the hour whether they are defending a £100,000 claim or a £50 claim.
and if anyone says no win no fee i will hit them!:D0 -

But if I dont do anything they get to keep my £50.
As I said it is the principal now - in fact I would go as far as to say that I will give the money to charity if I get it back (ok maybe half the money) I dont need a solicitor I dont think.
If everyone just accepted faulty goods and shoddy service where would we be?0 -

I started court proceedings and they had 28 days to respond. I got a cheque this morning for £49.95 from them with this letter attached:Thank you for choosing to buy your phone from Carphone Warehouse.
Please find attached your cheque for £49.95 in relation to your recent purchase. Should you have any queries regarding this cheque, then please contact our Customer Care team on 0870 168 0870.
Once again, thank you for buying from The Carphone Warehouse and if we can be of any further assistance please contact your nearest store, call our Customer Care team on 0870 168 0870, or visit our website at www.carphonewarehouse.com.
No mention of the court costs (£25). When I rang them they told me that Carphone Warehouse 'dont pay court costs'!!!!!!!!!
I am so cross it is untrue - anyway I have written to them with the following:Dear Sir/Madam,
Ref: Purchase from Carphone Warehouse – 26th June 2009 – telephone number xxxxx– purchase price £49.95.
Thank you for your letter of 28th August 2009, along with a cheque for £49.95.
As I have started court proceedings regarding this issue (and you have been fully informed of my intentions and given plenty of notice to pay), the amount has now increased to £74.95, including the court costs, so I would appreciate it if you would send me the remaining £25 within the next 7 days.
As soon as I receive the outstanding £25, I will consider this full and final settlement and will close all court proceedings.
I look forward to hearing from you and receiving the cheque.

If it's not actually gone to court, then why should they pay the court fees?
Your only option now is to actually take them to court, where CPW will simply say they gave you your money back and you rejected it. The court will then side with CPW..If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

I have already paid the court fees- I have already started proceedings and they will have got the papers, as I did, two weeks ago - I gave them plenty of time before starting proceedings to give me the money back without the option of court.
