Who's right, me or the insurance company?

Hi, I was looking for some advice.
I was coming up to a round about when I accidently went into the back of some one who had stopped waiting to join the round about, my car then carried on moving and went slightly into the right hand lane of a small round about and a car hit the side of my car causing small damage and drove of with out stopping or giving any details.
My insurance company are now saying that I have two lots of excess to pay out, even though the second accident occurred only because of the first one and both incidents took place with in seconds of each other. If I had not hit the car in front of me, I would certainly not have had the other car hit the side of me
I didn't think it would be classed as two claims and i'm afraid my insurance company may just be trying to get out of paying but maybe they are right.
I would appreciate any help or advice that anyone can give me.

A single excess should apply.
Insurers should look at the chain of causation. The second impact was a direct result of the first impact and nothing had occured to break that chain.
For example, if you had had one accident, moved your cars to the side of the road and then been hit by another car, the chain would be broken and the second collision would be a fresh incident. That did not happen in your case though.0 -
It sounds like the call centre (Offshore?) created two claims when you rang them to report, as Matty mentioned it is one incident and should attract one excess0

Iv finally had to report it to financial ombudsman service because they just refuse to take me serious, they even refuse to admit a second accident happened because the driver did not stop.
Any body had dealings with them? does it seem to work?

Then it may be they think this is damage from an unrelated incident that you are including in this claim.0

Yes they did say that, but this isn't my fault that the person did not stop and of course no witnesses stopped, but I saw and felt the car hit my side, it had to reverse to drive away, surely they cant refuse to pay out just because they get many accounts of fraud can they? What about the innocent people who are genuine?

They can normally tell from the damage and any rust etc if the damage is not fresh.0

Were there any witnesses to the accident by any chance?
Alternatively if you have the contact details for the car you hit first they may be able to confirm for your Insurers that you subsequently hit another car0 -
No they was not any witnesses, and I contacted the other driver, but she told me she got very dizy from when I hit the back of her car and cannot remember anything. Everything seems to be stacked against me. From the insurance point of view. because they are not any witnesses means it never happened.0
