Being asked to pay 1years council tax amount over just 6months!!!

    Unfortunately though, the council tax band of a property is not related to its current market value. This is because, by law, council tax valuations are based on the price a property would have fetched if it had been sold on 1 April 1991. For Wales the Valuation date is 1 April 2003. General price movements in the housing market since that date are not, therefore, a reason for changing a council tax banding.

    The reason why i endedup in arrears on the council tax was due to confusion when i moved in between me, my my landlord, and the landlord's property company as to who would be paying the council tax.

    There should be no confusion - under the Council Tax (Administration and Enforcement ) regs 1992 - the resident of the property will be liable unless there are certain defined conditions (the tenant will be liable 99.9% of the time).

    You need to clarify the charge you have been given with the authority if you are not sure it is correct.

    The Demand Notice you have been given goes to Feb - this is actually beyond the statutory instalment plan which only runs up to January or a minimum of 1 payment , which ever gives the most instalments.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    What do they class as ''low income'' though??

    Does it take into account the area of the country you live in?
    Or is it just a set amount for everyone to be classed as 'low', or 'not low enough'?? :(

    Because my income varies quite dangerously,
    since i work shift patterns, earn just under £100 per shift before tax and travel expenses are deducted... ect

    And i work between 13-16days per month.

    SO it can be a big difference of £200 less some months.
    And also i have to sometimes work at a different site, and if i work there i get ALOT less hours, and so my income then drops to barely £1,000 after tax. :(

    (Which in Surrey/London really doesn't get you much in terms of accomodation and travel)

    By low income they mean you have to have less than £50 a month disposable income. If you don't have a set amount coming in each month, they may work out the average.

    You could also go on CCCS's website and fill in the debt remedy, it will advise what is the best course of action for you, DRO, DMP etc.

    Due to redundancy I was on benefits however due to a monumental mess by the local council, they incorrectly assessed our council tax. We of course appeal and it was changed, again incorrectly, this happened 4 times. Iitially we were told that we were not liable for any council tax which surprised us and when querying it the mess began, however they woudl not accept payment because their system did not allow it as it was geared towards no council tax liable. Anyway at the end of June it was eventually sorted out but at no point were we at fault. We now fidn that we have to pay council tax at a rate of £120 per month for the next six months which is for us a high amount and we will battle to pay it as I am earning just slightly higher than the minum rate. If it had been split over the 10 month we could have only just managed the £95 per month. To crown it all we have had a DD set up since early June and although the money is sitting in the account, they have not collected it despite phoning them twice and being informed that the DD will be taken in the next few days.
    They are totally useless and when coming off benefits as a result of their mistake they left us with a rent arrears of £597 but that is another story that is being progressed through the small claims court. We did every legit and were above board and honest all the time but they have incompetent morons working at our local council. I ave told them that if they do not sort it soon i am going to cancel the DD and pay weekly as then i will be in control. They did not like that idea but are not leaving us with much choice!
