was going to sell my house but neighbours decided 2 build extention & wreckedmygarden

I have come home today really annoyed.....
Husband and I were considering listing our house for sale and moving until i got home today to discover that my neighbours have decided that they are building an extention and to top it all off they have cut down part of our hedge, drilled a meter thick trench from their back door to our man hole in our backyard which cuts past my back door. the place looks like a building site and there are workmen in my backyard.
i am so annoyed as I spent the entire bank holiday weekend doing the garden planting shrubs and everything it a bloody mess. i feel like crying. i phoned the planning office today to enquire if they had planning permission and apparently it was approved in 2004 a few months after we moved into the house.
i feel like i have been invaded and lost all my privacy.

I sympathise, that can't be right,they are on your property and have damaged your property if the hedge is yours. Do you get on with the neighbour, didn't he say anything.
If they are planning on laying drainage to your drain, then that doesn't sound right. It should go to their own drains or to the main sewer in the street.

Surely they can't do this without your permission, if they need access to your land? I would have thought they are tresspassing - planning permission or no planning permission. I'm sure you will get a reply from someone who knows the law on this sort of thing. Even if they are allowed they should compensate you for your plants etc.
I understand you feelings of invasion. I would be livid.

my husband now tells me that thefather of the women who lives next door said that they were planning on building an extention. they never said that it would affect us. all he said was that he would want to look in our man hole sometime. i dont know why? i cant even go out to see whats going on but it appears that they have laid a big brown pipe from their house to our manhole. what is this for? surely they should have their own.
what makes me more annoyed that my husband (forever the peacekeeper) wont confront them incase it makes things uncomfortable. the !!!!!! it is already uncomfortable. the nice weather is coming in and I now cant use my back yard.
if anyone knows anything about building etc can they give me some advice.0 -
You need to stop them now! It sounds like they are laying a soil pipe into your drain!
Tell them to get out of your garden and get a solicitor cause your going to need it all put right again, including your drain!0 -
Thats a solicitor to sue your neighbour not put it all right again! Imagine what they would charge for that!0

Sorry cant offer anything but by god, I feel for you. Sit tight and when you have a sec think about all the plants youve lost, write them down (if theres reciepts all the better) and keep it safe. Its not a priority as jimmmyc says, but worth claiming for somewhere along the line, if you can.:beer: Well aint funny how its the little things in life that mean the most? Not where you live, the car you drive or the price tag on your clothes.

Does your neighbour have a right of way across your property? Even if they have, it should be common decency to let you know when they intended to start the work.
Although it may be difficult at the moment, try & keep in with your neighbour, if you do sell the property you will need declare any problems that you have had with them to your solicitor.0 -
Unless there is a services strip through your garden then sue for tresspass, damage, stress and anything else you can think of.
And DONT go to a no win no fee solicitor as you could get loads for this. Do however doube check there is not a services strip as you would not have a case probably.0 -
Sounds like trespass to me. Could this mean that if a workman trips over your bin/dog/cat whilst they're on your property and breaks their neck they could sue you? Worth thinking about.0
