Seller not Selling!

Quick update..

I sent the last email I was proposing, exactly as it is in post #8. He has responded with the following: -

My sytem is set to return feedbacks as given,I.E EYE FOR AN EYE.....I have no control over your desires to express your feelings,but i have evry right to express mine as well.
In taking a decision,remeber i could have kept quiet and send you a faulty item and start an unpleasant experience which could cost you money returning item at your own cost.I did not do that.

So the ball is in your courts.

I haven’t fixing his spelling / grammar mistakes. It feels like he is threatening me with retaliatory feedback, and also seems to think that I should be grateful for him telling me the truth.

I would email eBay all these emails you have had from him and let them know and ask their advice. I agree with you for wanting to leave neutral and think he is being out of order for saying he will leave neutral back but unfortunatly this is what a lot of people do. I would also start a non performing seller against him - i've never done one so i don't know what happens.

Well, i did it, I sent the following information to eBay following their Seller
Non-Performance process.

I have no idea what happens next, knowing my luck, it will probably end up with me recieving a neg!

1. wundia04 failed to deliver the item for which payment was
accepted, see email dated 20 April 2006 18:31:23 below.

2. wundia04 significantly misrepresented the item by not meeting the terms
outlined in the listing. wundia04 states that item will be shipped within 24
hours of full payment being received.

3. wundia04 refused to accept payment for the item at the end of a successful
sale. Wundia04 refunded the payment and informed imranbashir_uk that the
transaction will not be completed, see email dated 20 April 2006 18:31:23 below.

4. wundia04 threatening to leave retaliatory feedback if imranbashir_uk leaves
any feedback, see email dated 21 April 2006 10:53:41 below.

I request, that a strike is put on wundia04 account.

I request that wundia04 is not allowed to leave feedback as wundia04 is
threatening to use Feedback Extortion which contravenes eBay Feedback Policy.

Got a good result from eBay, and it was relatively painless too. I still chickened out in leaving feedback for the seller, as I just know that he will neg me!
