Seller not Selling!

Hi,

I hoped my first post would be a money saving one, but I guess not!

I am after some help / advice, This is my first post, and I’m sorry that it is so long, ok here goes...

I purchased a faulty laptop from eBay, on 19/04/2006. For the curious it is item number 8797153396. I paid instantly via PayPal, and expect the laptop to be delivered in a couple of weeks max.

I got an email from the seller today stating: -

Hi, while putting this item thru final check before going out, we discovered the item was wrongly listed. The hard drive is 6gb, the bezel and inverter + plus cable is missing and item shuts down at times.

We will offer you a refund and let u know if such item is listing soon. Sorry for the mix-up.

Although you have provided me with a refund, I am still left out of pocket due to PayPal fees this in itself is not much of an issue as is only amounts to £0.68. Unfortunately, I had already purchased a power supply specifically for this laptop after winning your auction, see eBay item 6871687559.

The power supply cost me £14.76 including delivery.

With this in mind would you still be willing to sell the laptop to me at a reduced price, so that I am not out of pocket.

I would appreciate a quick reply,

I have edited the sellers emails slightly only to correct spelling mistakes. I was aware of his less than perfect feedback, and to be honest I wasn’t expecting the earth.

The item in My eBay, is now showing as though I need to pay for it, which makes sense as he has refunded me, but does this mean he can now do a ‘None Paying Bidder’?

I know I can’t force him to sell me the item, but how can I let eBay know what he has done, is there a ‘None Performing Seller’ equivalent?

Does he still get the right to leave feedback?

I don’t know why but I think that the Laptop didn’t make as much as he expected, or he is selling the screen separately to make more money, and this is the reason he has refused to sell to me.

Any help / advice would be greatly appreciated and thanks for reading...

  • Hi, you as the buyer don't pay any fees. The only way you've lost out on fees is if the buyer hasn't refunded properly. When they refund through ebay you get the whole lot back, and they dont pay fees.

    if you both are agreeing to not go through with the deal then they should do an unpaid item dispute but they choose the option that you both agree, you then agree to it and they get their final value fees refunded. They only lose out on the listing fees.

    It sounds like they've refunded straight to your email address rather than through ebay, or they've simply taken off the pay pal fees, which they wouldn't have had to pay anyway - they have didled you on that.

    I wouldn't bother with reporting them, just hope they aren't too dodgey and do give you a strike, and best to move on.
    And yes, you can both leave feedback, but I probably wouldn't.

  • The seller refunded directly to my PayPal account, not through eBay. So PayPal deduct their fees. I’m more worried about the power supply I bought just for that laptop, which I now no longer need as this cost me £14.76

    I haven’t agreed with the seller, that I don’t want to go ahead with the deal. I actually do want the laptop, I even offered him a compromise, that I will still purchase the laptop even though it is a lower spec / has more faults then he listed in the auction.

    But his reply seemed odd, that he would wait and see what happens latter on in the week?

    Surly, he must be breaking some eBay rules?

  • Hi, no, you don't pay fees to pay pal at all when you refund back to a buyer.

    I think you just have to trust that the seller is being honest with you - if you can prove otherewise then report them.
    It's a bummer you bought the other thing to go with it though.
    it could be they need to speak their partner about the sale, maybe that's what they mean by later in the week But if it was me, I'd just try and bag yourself another bargain somewhere else, it doesn't seem like they want to sell you this now, and you can't force them.

    You could put it back on ebay to sell, may even make a bit on it too!

    Yeah forget about the seller now - nothing you can do. Just my opinion, I wouldn't buy the lap top off him now in case its worse than even he's admitting.

    Try and sell the power supply yourself on ebay and hoopefull you can make back most of the money.

    Ebay can be a cruel business at times - just try and learn from it.

    If he sent you a paypal payment, you'll have been hit with fees. If he did it properly (clicked refund) there will be no fees to you.

  • I stand corrected, I just double checked, and I haven’t been charged any PayPal fees. I thought I did because, not all the amount got refunded to my credit card. I had some money in PayPal already (£0.68) so that’s gone back into my PayPal balance and the rest to my card.

    I probably won’t buy the laptop from him, but I’m sure he has done this more than once. I want to let eBay know about him, but not sure of the best way to do it. Any advice?

    I also want to leave him some feedback, just to warn others. I was planning on sending the following email to the seller.

    It is unfortunate that this auction cannot be completed, due to you listing the item incorrectly. I understand your reasons, and am glad that you have provided me with a refund. I would like to leave feedback that is appropriate and reflect the dealings I have had with you through this transaction.

    “Buyer paid instantly. Seller refused to complete transaction and provided refund”

    If you have any concerns with this please let me know in advance, I do not expect any retaliatory negative or neutral feedback, as I have not done anything wrong.

    What do you think, is this appropriate, or shall I stop trying to be a good smarten and leave it as lessons learned?

    I’m also worried that he might try and hit me with a NPB strike, as the item is showing as ‘Pay Now’ in my eBay. How do I prevent this, I’m not willing to do an ‘unpaid item dispute’ because it is not an unpaid item, it more like seller not performing!

    You should be OK. The seller's feedback will look even worse with another neg!
    He's also listed from a non-UK country saying he's in the UK and is charging at least £20 postage even if the item is collected!
    You got quite a good deal on the PSU as it is a 4 amp one and will work with more machines than listed. Most Toshiba PSUs at this price are 3A so you shouldn't be out of pocket.

    On the subject of unpaid item strikes - I had one once that arose in error. We wanted one item and accidently bought 2. We e mailed the seller and apologised and they were fine about it, agreeing that they would accept payment for one without a problem. I had had the same happen to me once.

    We paid for the item and left good feedback for each other. I was then later informed by e bay that there was an unpaid item strike against my account. I contacted the seller and reminded them about what happened and copied all correspondance to Ebay.

    The seller quickly agreed to put things right but by that time ebay had upheld my appeal against the unpaid item strike and removed it.

    So don't worry about unpaid item strikes arising out of misunderstanding or even malace

    I was just wondering what the Seller Non Performance process entails. Would this be the appropriate way to inform eBay?

    Has anyone ever used this process, and can it prevent the seller leaving me negative / retaliatory feedback?
