If the item you bought does not look or function as it was advertised, or if it is not satisfactory, you have the right to have the item replaced at no extra cost or to get your money back if the replacement was not completed in a reasonable time.
I like the fact you put or to get your money back but did not do the same for if the replacement was not completed in a reasonable time.

Quite clearly a machine which develops a fault within 8 weeks is not fit for purpose it was intended and any reasonable person would agree, however, reason is something that clearly isn't being demonstrated here !0 -

Exel, you are correct.
Only a court can decide a resonable time. This would be based on the original cost and how long the item would be expected to last.
I would reason that 3 months for a washing machine that probably cost a couple of hundred pounds is not reasonable and a court would award a refund. But, it is only a court that can decide.Don't lie, thieve, cheat or steal. The Government do not like the competition.

But then i would imagine a judge would take into consideration the fact that you HAD actually used teh washing machine succesfully on x amount of times within the 3 months and adjust the award accordingly.
I am no expert on how much the rental of a washing machine is but I would imagine it is about £10 per week.
so £10 a week * 12 weeks (give or take) is £120. They would probably round down in your favour so they would deduct £100 from your award. so the vendor gets teh washing machine back and gets to sell it second hand at no real adverse affect.

i'd rather accept a brand new replacement washing machine from the vendor without involving the courts. (Or at least that is what I personally would ask for)0 -
YES, they are entitled to a refund and if I wish to 'start on' about the EU and SOGA I will. I'm fully aware that that SOGA exceeds any EU requirement but maybe the OP isn't.

The goods were accepted as they have had them for three months.
There are many threads with this EU Directive involved but it holds no water.
