Barclaycard CCA's - How are people getting on?

I know from threads I have read/made that there are many of us going through the CCA process with BCard and just wondered how people were getting on, if they had any success stories or updates for us all to share?
I know a few months ago, a 3 page legal-ese letter was sent to quite a few of us on here, so was also wondering if people had pursued it after that and how they had got on?
I replied to them pointing out where they were wrong and have had a totally dismissive response saying they have done all they are going to do, or words to that effect, so not really sure what happens next.....
Thought it would be good to share?

Thanks in advance0 -
Hi Blue is the Colour, probably not much help but here is the response they sent to me
My 12 working days are up 12th August, I note their letter states my CCA is being sent under separate cover. What did you receive?

Similar to that, some T&Cs with no reference to me on it at all, so I wrote back saying that wasn't acceptable and then they sent a 3 page legal-ese letter that an average person couldnt understand, so again I wrote saying they hadnt fufilled their obligations, but they wrote back the other day saying they had, so we seem to have reached an impasse, a friend is preparing me a response letter this weekend.
They've been totally useless, considering I first asked them for it a year ago.....Me thinks they dont have it.....0 -
Thanks blue,
is it worth paying £10 for SAR to get a once and for all answer?LBM 30/6/9 Unsecured debts [STRIKE]£25,323.48[/STRIKE] £0 :T Debt free

Also, during the time you are disputing this are they adding interest and continuing collection attempts? We are self-admin DMP and wonder if it gets to the stage where a dispute is reached should I stop paying them during this time?LBM 30/6/9 Unsecured debts [STRIKE]£25,323.48[/STRIKE] £0 :T Debt free

Not sure on a SAR, I haven't done it but plenty of people have, I have thought about it several times but never got around to it.
As for their collection attempts, at first they continued to the point of harassment, only stopping when I complained to the FO, during which time I didnt pay. They then agreed to my token payment offer under FO instruction which is where I am now, athough they did agree to that and passed it on to Debt Managers virtually straight away, so I got back in touch with FO and that seems to have stopped now, dont hear from them at all, apart from all this CCA stuff....
They did say tho that I would have to contact CCCS after the 6months are up, and before I got the FO involved I was trying to self admin a DMP and they were the only one of my creditors who wouldnt accept it, hence the FO complaint!
Their in house people use many different names and pretty aggressive, so I got my phone number removed from their records and only deal in letters now.
Good luck with them.0 -
Thanks blue, I'm not looking forward to it.
Depending on the reply I get from them when do send "our" CCA, I'll pursue them for the SAR. Could be the best £10 every paid?
Me thinks too that they don't have it.:D
If it appears they don't have it I am hoping to offer a really low F&F.LBM 30/6/9 Unsecured debts [STRIKE]£25,323.48[/STRIKE] £0 :T Debt free

My story to date-
a)Following forum advice sent off a SAR. Got back 'statements' for 3 accounts indicating they were cleared in 2007 ! God knows how. They claimed that this was all the information they had
b)Sent a further letter requesting all the information asked for and giving them a further 30 days to comply
c)Yesterday got a letter from Lowell (who somewhere along the line I'd been passed on to ) saying that BC 'couldn't provide the information requested' and that they (Lowell) had made a 'commercial decision' to write off the loan but 'with no admission of liability'.
d)Going through the paperwork -again- BC have now passed on 3 alleged accounts that aren't mine to 4/5 different debt collectors. All failed because there was simply no paperwork to back up these non-existent debts
e)Got an 'agreement' but this was a badly photocopied Microfiche ? page that was only the application bit with no BC signature/no terms and conditions etc
PS really appreciate this thread as I was beginning to think I'd lost my sanity in dealing with BC/Mercers . There really does seem to be a pattern to this Thanks folks !!!!!!0 -
Well done Eira. So if the debts weren't yours how did this all start?LBM 30/6/9 Unsecured debts [STRIKE]£25,323.48[/STRIKE] £0 :T Debt free

What do you plan to do if they cannot supply the CCA? I have not asked for CCA's from anyone as I admit I owe the debt so I cannot see the point. If it did go to court surely you have to admit owing the money so why would you dispute then CCA? I have had my Bcds for 20 years and assume they would not be able to supply CCA but I do owe them the money. Am I being thick as I cannot see the point as most people on this site admit to owing the debt and want to pay it back.0
