Stu V Abbey SAR FAILURE QUESTION

Hello everyone

I am new to this site, I have had two successful claims for Bank Charges and I am awaiting for the outcome of SAR for Bank statements with the ABBEY for an other account so that I can claim on that one. I am ok so far on this.

I have an issue- where as I have around 7 closed credit card accounts that I want to claim back charges for and an Egg/Sainsburys Loan account. I can remember on the CC that they where charging me £30 a go for late payments, over credit limit etc etc and the Loan with Egg I have a feeling that it may be unenfoceable with the LA that was sent to me(after reading this site) and also some of the cards had PPI on that i did not sign for.

Ok so the issue I have if anyone can help-All of these accounts are now closed and I want to claim all these charges back or see if the loans /cards where enforceable. Can I still claim if these accounts have been paid off and closed down, also I have moved address since these where paid off, could I just send a SAR to all the creditors I had, Virgin, Egg, Marks and Spencer,Citi, Abbey CC and Sainsburys, give them my old address and my new correspondance address and ask for all the data they hold on me and a list(not limited too) of charges and transactions etc etc going back to when the cards/Loans commenced.

I am really stuck on this one.

    Bump-Sorry looking to SAR if I can tomorrow

    Yes you can claim all of these, even if you have closed them. I had a capital one credit card which i paid bk 3 yrs previous, also monument and aqua credit cards. my brother claimed bk his ppi from loans from 5 years ago, a few of them. So there is hope. lol. Good luck.:beer:

  • Stu, if you are reclaiming the charges back on a credit card but you are stating that it is unenforceable then you have a big problem. Plus, on the enforceability side of things, can I ask why are looking at it if they are closed?

    Hya, I didn't word that thread very well.
    What I am looking to do is the following.
    I have some closed and open Credit Card Accounts with Egg, Citi,Virgin, Abbey and Marks and spencer store card.
    With the cards I am looking to claim back just all of the charges ie the £30 a pop ones, late payments and over limit. I am not looking to see if they where enforceable.
    On the Egg Loan and Sainsburys Loans(all closed), I was going to see if they where actually enforceable and try and make a claim, but in hindsight I think this is a no go as they are closed and paid off.The loans did have charges on though for missed payments etc etc so I might be able to ask for the charges back.

    Ok so here Goes

    Still waiting for Abbey statements to come through, aske last week for online access and got my passwords today.
    I managed to get as far back as July 2007 online and have done my calculations.
    Any words of wisdom on a issue, I think I know the answer though, I have sent
    my claim in today recorded for claim from July 07 to todays Date.
    When my statements come through can I just ammend the amount on this claim or do a complete new claim for the outstaning time as I reckon the amount will be double.

    Personally I would wait for the statements and do it in one go cos it keeps it all simple rather than sending one list now, then amending it again cos you can probably be getting your teeth into the credit card claims beforehand ;)

    Cool Aces, just a quick one in respect of the cards that have been closed, I have no statements.A/C no etc and they where at an old address.

    One is Citi and the other is Egg, I believe they are both A**** with anything.
    Can I just send them my new address, old one, DOB etc with the £10

    Incidently I was thinking last night ,I have a closed step account with NW that had around £1500 in charges, again no statements or account details, all's i remember is that is was the Stockport Office , would I be able to send them my name, new address, old one, DOB and £10??

    Absolutely, send as much info as possible to identify you, preferably when the accounts were closed if you can remember.
