Are Virgin Mobile ripping us off?

My partner and I just bought two brand new mobile phones from Virgin. One was for my partners son for his birthday. The phones were ordered on different days.
It wasn't until after we had given the son his phone that my partner noticed the shipping label was from a company called K&N repair service.
She checked her box and sure enough hers was sent out from the same company.
When she phoned Virgin mobile, she was told the operator at customer services had simply made a mistake and 'pressed the button' to have re-conditioned phones instead of new ones sent out.
So two customer service reps on two different days, 'pressed' the wrong buttons to two different clients at the same address. Likely? Oh, and she had to point out that the orders were taken by two different reps on two different days from two different customers and both had made the same 'mistake'.
If we hadn't looked at the shipping label, we would have been none the wiser.
Is it usual practice for companies to send out re-conditioned phones, even if the customer thinks they are buying brand new ones, and have paid the full price for a new phone? And if so, is this legal?
