    This is correct, and is probably the same with all retailers. However I should add a few points.

    The mattress obviously wasn't as described, so you can return it under DSR's and SOGA. In this case you shouldn't have to pay return postage.

    Even if it had been as described, then as you haven't opened it then you could return it under DSR's, but they could charge for return postage.

    In either of the above cases they can't charge a restocking fee.

    If you are concerned about getting your money back then if you paid by card you can raise a dispute through your card company, who will hold the money and refund you when the mattress is returned.
  • Mattresses are not subject to any exceptions under DSRs. They can be returned even if opened.

    The DSRs are there to protect consumers - not retailers.

    They can charge you for returning the item under DSRs though but only if they make this clear at the time of purchase. In the case of mattresses you are advised to be very clear on who would pay return cost under DSRs as the cost can be prohibitive.

    What the previous poster said is actually very misleading. What I have told the OP are the facts.

    1) Mattresses do come under exemptions under DSR's, but this doesn't apply in this case because the OP hasn't unpacked the mattress.

    2) If T&C's state they they may charge for returns then they can. But again this doesn't apply in this case because the item isn't as described.

    Of course you can buy a mattress and unpack it to examine it and return it under DSR. Stick to your main job Tim...I do hope your better at that.

    Perhaps you could point us to the FACTUAL evidence supporting your statement that mattresses are excluded under DSRs due to hygiene...

    I know the facts on this, as you would expect anyone in any line of business to know the laws related to that trade.

    One thing that I really hate is when people seem to think that just because they may have some legal qualifications, then they are an expert in all matters legal. Well in this case Gordikin, I'm afraid you are wrong, so stop getting personal about it. Especially as you are off toppic, as far as the OP's issue is concerned. You two are just being disruptive rather than helpful.

    No I'm not wrong. If you want to find the facts then find them yourself as I had to. Because this discussion is off topic and unhelpful to the OP.

    So rather than using this thread for personal attacks on me, maybe you should leave and stop being disruptive.
