Caught Driving Whilst Banned!

Hello everyone,

Someone I know rather stupidly has been an absolute idiot and drove his car whilst banned. The police stopped him (quite rightly so) and his car was sent to the impound yard until someone with adequate insurance can pick up the car. However, most insurers now exclude picking up impounded cars as covered under DOC extension exclusions and I think my friend best kiss his car goodbye for being a fool!

Now, can he get insurance as a banned driver (as he is still legally banned) and add a named driver on the policy to get the car recovered (and it is getting sold, he is not driving it again as I will not allow it now I know what he's up to)!

Or is it as I thought, if you are banned, you cannot be insured. That's how I always thought it worked.

    His best bet is to sell the car to one of his friends and for them to Insure it and then pick it up, the compound will require to see all of the sale documents and V5

    Or he could approach a local car dealer who will buy the car off him (Normally at a reduced price) and they will get the car out of the compound and then sell it.

    remember the longer its in the pound the more he will have to pay to get it back!

    Maybe I'm missing something, but most comprehensive insurance policies allow you to drive other people's car's with third-party insurance. Hence anyone of your friends (or possibly you), should be able to collect the car by taking your existing document to the impound.

    Note that this would only be third party insurance, but this is sufficient to allow someone to legally move the car. Should you have an accident, insurance would not cover the repair/replacement of the currently impounded car. Nor would you have a claim should the car get stolen while in your hands.

    Unfortunately the vast majority of compounds will not release a vehicle to some one who is using the "Driving Other Cars" extension on their policy. In fact a lot Insurers have changed the wording on the Certificate to state it does not cover a vehicle being released from the compound.

    dacouch - as correctly identified in your last post police compounds are now very reluctant to release vehicles under the DOC extension.

    The same is becoming true of the Motor Trade. They will not release vehicles to a motor trader who did not own the vehicle (or it was not in their custody/control in connection with their their business) at the time it was seized.

    They often do release to Motortraders if the paper work is in order eg sale documents and V5 completed and it shows on the MIB. But it does vary from compound to compound and from person to person.

    Depending on the compound we sometimes have to write a manual covernote or get a Certificate from the Insurer to enable to the Motortrader to release the vehicle.

    I know of a few motortraders who make good money from this as they buy the cars cheaply as the person who has had the car impounded has no choice and then sell the cars on for a tidy profit

    I believe it is for this reason that a "crackdown" is impending. It's hardly in the public interest and is verging on extortion IMHO.

    I agree, the impounding cars and the MIB is a fairly new concept and they are stilll ironing out problems and hiccups like this. They have already stopped people using the Temporary Insurance Policies to get cars out and the ABI / Government are asking Insurers to word the DOCs extension to prevent cars being taken out that way.

    There are other ways cars can be released for a relatively low amount which will no doubt become common knowledge and hopefully these can be also be stopped.

    Why isn't it?

    Someone who knowingly breaks the law by driving whilst banned or uninsured knowingly takes the risk of having his car impounded. It seems to me that it's very much in the public interest and if a motor trader happens to make a profit out of it, I don't see a problem with that.
