Yes, there is a legal obligation from the seller to refund the return postage on a faulty item. It is in the DSR's.
The seller is NOT paypal and NOT ebay. Therefore, you cannot chase them for this money.
Yes, Paypal / Ebay may have rules that buyers and sellers have adhered to and no this does not override UK law but...
Paypal do not have to force the seller to refund the return postage, they are not the police.
Your dispute is with the seller, and you should be chasing this person for a refund. Legally, the seller should refund you (ideally within 30 days) even if you have yet to return the item. (though he can try to reclaim from you via the courts too)
Smashed - I am taking note of the comments made and of course I have right to make up my own mind. I believed rightly or wrongly that I should have been protected by paying through Paypal. I am aware that my contact is with the seller and not Paypal and I am pursuing this with the seller. That does not stop me from thinking that Paypal could do more in these situations, that's my opinion and I am entitled to it.
My response to Premier was justified, his posts were sarcastic, unhelpful and unnecessary. I am new to this site, and quite honestly shocked at how some, not all, users seem to take some sort of perverse pleasure in having a go at others.0 -

I'm sorry but you need to go back and re read this thread very carefully. PayPal do not need to comply with the distance selling regulations, because they have not sold you anything. Now you ask about buyer protection, this you have, PayPal will refund you if they receive a valid tracking number, this is your buyer protection. PayPal can not and will recover funds that they have not processed. Your problem is with the seller, PayPal do not enter into it. Imagine if you had paid by cheque.... who would you pursue ? The bank or the seller. All of this is made quite clear on ebay & paypal, if you bother to read.0
