claiming fathers life insurance problem..

Hi i have a problem with a policy my father died in january he had a life policy it wasnt unitil the begining of july i found his policy number etc..upon phoning to make a claim i was informed that the policy had been paid out in good faith to his brother who claimed on the policy in feburary he has also passed away in may. he obviously made a false claim saying my father had no children when asked and said he was next of kin.upon speaking to the claims department they have informed me there is nothing i can do as the policy has been paid out.many thanks

    Don't take their word. See a solicitor about this.

    dont they ask when you take out the policy next of kin when i did mine i had to tell them next of kin so things like this dont happen. my friends sister died and she had not changed hers and her money went to a bloke she lived with when she took it out but that she had not seen for years and they could do anything about it.

    The policy was took out 25yrs ago and my father didnt put down a proposer on the form it was left blank.

    definatly get leagal advise im sorry to hear about your problems. have you spoke to your family must be a hard situation to bring up

    The brother would have had to supply a death certificate. If he commited fraud then the police would normally have to be involved. However, as he has since died, that makes that option a bit difficult!

    How did the brother get hold of a death certificate?
    Who was executor of the estate?
    Was the life policy in trust?

    yes his brother did supply the death certificate because he registared the death.
    they both lived close by as i live in another county he insisted.my father died suddenly he had no estate as such he lived in a council flat etc..his savings were also cashed in not much but my uncle (his brother) did that too.
    the policy was a rolling one in which my father was still paying until he was 65 it still had 9 years to run.

    how much money was involved here. There may have only been enough to cover funeral costs so dont go in all guns blazing.

    Its easy enough to get a copy of a death certificate.
    Just a few pounds at the registry of births, deaths and marriages.

    well...this leads to something else yes my uncle did arrange the funeral he wanted too?(now i know why)savings,insurance purposes,but when my uncle passed away i sorted his out upon arranging his funeral i was told by the funeral directors that my uncle only paid the deposit on my fathers and there was an outstanding bill of 2 grand!!
    my uncle has no esate really althought he did have his own property he had no protection on it roughly im stil working this out ref his estate he has approx 80k mortgage and debts and only approx 65k including value of house coming in..i think the policy is only for approx 3k but the thing is surely this shouldnt happen and/or if did then its the insurance companys fault for paying out to the wrong person.
