Need advice!

I swear I must have a sign on my head saying please destroy me and everything i own! Need advice on how to go about it now though!
Thursday night, came home from work in the car and I live near to a workingmens club. there were four drunks in the middle of the road and i waited patiently but they didnt seem to be moving. I beeped the horn once and one of these men decides to come straight at me, put his fist through my car windscreen totally cracking it and when i wound down my window to ask why he did it, he punched me in the face.
now i called the police but as the guy run off, i dont have a clue who he is and no reliable witnesses, the police dont want to know!
i have just had to pay my windscreen excess and feel that surely the club has some responsiblity in this matter as they allowed this man to consume so much alcohol to get in that state. They also surely have a responsibility to keep residents in the area safe.
I dont feel safe in the area no more and there is only one way to access my house, which involves passing this club.
Just wondered if anyone can give me advice on whether i can take the workingmens club to court to get my excess back, or what i can do otherwise?

I don't think you can hold the working men's club responsible. They could turn around and say that the men in question were reasonably sober when they left the premises, and must have consumed the alcohol elsewhere, if in fact, they even know who you are talking about. Very hard to prove. You could contact victim support and see if they can help you or advise you.

no i dont assume. i know they were in the workingmens club. right now, im afraid 2 live near the club, so going in there is out of the question at the moment.
i study licensed premises in uni and i know that to keep their premises license, they have to adhere to certain rules to keep the license. they have broken these rules already as public nuisance is one of them.0 -

certain circumstances led to these people being in the club so the club could not turn round and say they were never in there and definately not that they were sober. they know what i would be talking about aswell due to me going inside the club after it happened as i wanted to know details of this man,0 -
Whilst I don't want to appear unsympathetic and I hope that you are physically recovering even if emotionally you are still a little up in the air, what on earth were you doing opening your window to someone who had already shown you enough violence by punching your windscreen?
Can I suggest, since there is no quick solution to living near a licenced premises, that in future you show a little more common sense and remove yourself from the situation rather that possibly inflaming it.
From that, I am in no way implying that you deserved the treatment you got, nor that you should move because of it, merely that you were sober (I hope - since you were driving) and should have thought your actions through, whereas the drunkard just reacted, possibly thinking you were winding down your window to threaten or punch him instead.Cross Stitch Challenge member 11 - May challenge well under way

Foxy - I gave my opinion based on what you had outlined in your OP. It is now taking on the guise of a Miss Marple mystery. You mention "certain circumstances". If you are, indeed, conversant with the licensing laws, then take it up with the owner of the club. I, personally, know very little about licensing laws. im just still a bit shook up about this all and knowing this guy has now got away with it, just makes me feel even worse. i will have to contact victims support tomorrow and see what they say

Wouldnt have wound my window down - would have accelarated straight at him. Then reversed (to check he was ok :rolleyes:)
Only thing you can do is complain about noise, rowdyness, and try and get their licensing hours reduced or removed.
If they were definately from there go back to police and ask for a crime nimber and claim on your insurance and ask to see cctv footage from club.
They wont let you but then you can chase police to ensure they DO view it. If they cant be bothered watching footage (when you can restrict the actual time of crime to within 15 minutes) then letter to local paper and MP (cc Chief constable of your force).
Should get a result.
If no CCTV - then not much chance.0 -
thanks ukjoel but no cctv. thats why im pretty much stuck!
figure the club should be held responsible as they gave him the alcohol, they knew the state he was in, yet they still continued to serve him. in my pub, we tell people who have had to much to move on. not the same procedure in all pubs i know now.0 -
at last, some good news! cctv footage from local community centre shows the 2 guys running!
surely they can catch the little swine who did this to me and my car!0
