£1200 down the pooper ! Advise please !

So, it started when we went into DFS and found the sofa of our dreams - a DFS Hemingway (don`t knock it folks, as I love it !)
After scrolling through the listings on ebay, found a seller who was selling ex-display models for £1500 or Best Offer! :j
The one in DFS was ex-display at £2650, so thought we would take the plunge and go with the ebay bloke as his feedback was fantastic! Offered £1200!
Sofa came (it was raining).. it was wrapped in cling film and having to be stored in the garage as we hadn`t got rid of our old sofa yet, but from the parts I could see, it looked lovely.
Well, today was the day we were bringing it in and setting it up....
Piece by piece we brought it in with the help of a neighbour, each piece had a fault... either marks, rips, scratches or stains. :mad:
The Footstool was the worst, with a broken zip, moth holes, white blobs on it which look like paint and ink stains !!
The other bits all had tears on there bases and marks on the seat cushions.
For the money we paid, I could probably endevour to get some of the marks out myself, however the footstool is the thing thats annoying me the most!
He advertised that its a 6 month old ex-display model, well stone me if it`s 6 months old - i`ll eat my own shoe!!
Have emailed seller asking for a replacement footstool as he is still listing the corner groups on ebay!
Haven`t heard anything from him and am thinking I probably won`t.
Paid cash on delivery also... :eek:
Any suggestions of what else I could do??!!

Talk to the seller before you do anything else. Although a model sat on by thousands of people over a 6 month period in a showroom would have quite a few marks and stains I would have thought.
If seller can't suggest a compromise your only recourse would be small claims, and even then you would have to show that the item wasn't as described. What did the auction state about condition, did it mention perfect or anything like that to help your case. How long had you stored the item for. i.e. how long ago was it delivered?
Certainly sounds like it could well be not as described. Unfortunately you didn't take up the protection payment by paypal would have offered, so it's down to negotiating directly with the seller to try and resolve the issues.
If that fails, then as soolin said, try small claims court.

I'd say that alone is grounds for a refund. Failing that, take a copy of the listing now in case you need to try legal action...My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -

I would actually seriously go through the small claims route, my friend had a similar ebay problem, paid a small sum for the court process all done online, only about £30 I think, forms were sent, a couple of days after the seller received forms he coughed up! I think court is very scarey for anyone!

Could always ask the seller if he would pay to have the whole suite reupholstered or replace the most damaged item for one of a better quality. I don't think he'd go for the reupholstering as that can be pricey.

Is it me or is the left hand sofa a different colour than the others in the leather? I thought it was just the light in the photo but its the same in the other pictures too
