    I normally advocate writing, and still advocate it for confirming any climb down or for taking it forward if there is no climb down.

    You merely need to state the address of your rented property, confirm that you signed for a further Fixed Term of six months ( from xxx to xxx) and that they seem to have made in error in trying to serve a premature S21 notice of intent to seek possession of the property prior to the actual expiry date of your contract. Tell them that you look forward to receiving confirmation of their mistake, and will of course be remaining at the property for the duration of your tenancy agreement.

    If your rent is less than £25K pa, and the property is let on an AST & is in Eng/Wales then your tenancy deposit should have been scheme-registered and "prescribed information" given to you by the LA/LL - has this been done? ( If it hasn't then they cannot serve a valid S21 until the deposit *has* been registered, even if they got their contract expiry timings right.)

    You may want to contact the Private Sector Rentals Team/Tenancy Relations Officer at the local Council for help with this - they can speak direct to the LA/LL if you need them to.

    I am fully behind the plan to write a recorded delivery letter and NOT to telephone. The chances of the OP getting irate due to the stress of being given an illegal notice to quit and having a pregnant wife cannot be underestimated. It would do no good now to say something you might later regret, get the letting agents backs up as they might just trump up reasons to get the OP to leave.

    sorry not been back untill now, but have been looking at other properties to rent and it looks like that we can move in around a months times, a month before they want us out would i still have to pay for the month?

    Thank you for your help with information relating to my predicament.

    What a couple of days it’s been since I started this thread, been seeing properties over the weekend and seeing a property tomorrow.

    I have been in contact with Shelter and have an appointment.

    Spoken to the local council and housing associations about social housing but nothing available until I retire as the list are so long and I don’t want my family to go into hostels. But I’m still going to go on their lists just in case; you never know something might come up.

    Been to so many websites that they seem to blur and keep seeing the same properties on them but they have all under consideration or gone. Been scanning the local papers as well
