    I was not told of any of these costs when signing up, he assured me that we wouldn't have to pay the HIPs pack if they couldn't sell the property.

    You were told, in the contract. Unfortunately they lied to you in their sales patter. Do you have any evidence (emails, flyers) to contradict what the contract says?
    Besides this I refuse to pay these costs and they can keep the house on their books which will in turn end up costing them more money

    Which is kind of the point of these fees for them.

    There may be features of the contract which can be deemed unfair terms - for example, never-ending contracts can sometimes be that, especially if not made clear except in small print.

    But you need to go to court to establish that. Someone here once posted a list of court-decided unfair terms (as opposed to the OFTs list, which is only guidance) but I can't find it.

    Let me tell you, and any other agent haters on this forum, that you should think yourself lucky that there are some of us (agents) that FREELY give our time to help many who are grateful. We don't just post the same old tripe, time and time again, we post useful facts and often help those who are in dispute with their agents.

    This MSE is a good community spirit and is spoilt by your illiterate ramblings, usually without a logical argument.

    Many EA's are not good but some are so perhaps you should of taken more care when selecting one.

    Giddings, could you see if they will let you go dual agency with another EA? If you agree that you will still use them for conveyancing, they may allow you to keep the free HIP. It's definitely worth a try anyway, you stand to have to pay a lot of money out otherwise. If you have had a lot of viewings, are you sure it's not the price putting people off? What sort of feedback have you had?
