As you might have read in my original post, the OH has debt from 1999 with another DCA - Wescot, but she is just paying these every month. This is from before I knew her and she got in trouble finance wise. Again, they traced her to when she moved into my house.
Now, the OH is happy to keep paying them, because she can remember what the debt is for - Goldfish, and I help her out. But reading all the threads on here and what we are experiencing with MH and not knowing exactly what that debt is for, should we ask for a CCA off Wescot as she just started a payment plan without asking for any proof of any debt.
I'm in quite a strong financial position and other than the mortgage, I don't have any debt. It's not in my ethics to not pay what is owed, but we get wed this year and if she can get out of paying for old debt, then I'm all for it! I wouldn't want anyone to think bad of us though. I'd rather us spend the money on our wedding as to 10 year old debt!
The debt to Wescot is £1,300 - is it wise to ask for a CCA as I take paying every month has acknowledged the debt?

How long prior to Westcot contacting her at your address was it since she last made a payment to them? If the 6 years had gone and then she paid them, the statute barred ruled still applied. They could ask for the money, and she could voluteer to pay it, but they have no way to legally enforce it.
At worst doing the CCA request gives you a strong position from which to negotiate a full and final settlement. Remember these companies will have paid peanuts (10p-15p in the £ is common and as low as 2p for people like MH).
She defo needs to check they are not sticking stuff on her credit file they shouldn't be as if you got married it could effect your credit rating.
MH once sent a letter to my mum and dad about my sisters ex, how dodgy is that.Dad was going to phone them up till I stopped him, I told him to either ignore the letter, or send it to the OFT. Think he emailed a copy to the OFT. Never heard anything again.

What have you got to lose Scrabbler? As has been said, if there were 6 years of no activity its statute barred and the bottom feeders are laughing all the way to the bank if your OH is paying them....

It is always to ask the ilk of Wescot, for a cca. This will establish their legal right to 'pursue' the debt - Wescot are not known for their 'respect' for the Law, but they are known as a bunch of greed driven chancers, and will, often, pursue debts which other, dare I say, more respectable DCAs will not touch, simply because they know that the 'debts' are, most likely unenforceable.
Wescott, as do MacKenzie Hall, 'go in strong', so as not to give the, often unsuspecting, 'debtor' a chance to either question, or take advice on, their legal position.
Many of their unwitting 'victims' will simply bite the bullet and pay, thereby lining the pockets of DCAs like Wescott, at considerable, and often unnecessary, hardship to themselves.
If Wescott can not provide the cca, it does not matter that you/your partner have been making payments, nor for how long -Wescott are powerless to continue enforcing the agreement and must cease all collection activities until such time as they either 'produce' a compliant copy of the original executed consumer credit agreement or get the necessary 'permission' from the Courts to 'enforce' the agreement.
Since they have probably purchased the 'debt' from the Original Creditor for as little as a few pence in the pound, they have little chance of providing the necessary paperwork.
Even if your partner does acknowledge the 'debt', she has probably already paid much more than what they purchased it for, and, in the absence of a cca, she would be in a much stronger position to put a 'closure' on the whole account - possibly through the offer of a 'Full and Final Settlement' of around 20 - 25% of what is being 'claimed':
