    There are a lot of different response letters for harassment by telephone floating around. This is just one example posted by fermi:

    I now require all further correspondence from your company to be made in writing only.

    I am of the view that your continued harassment of me by telephone puts you in breach of The Consumer Protection from Unfair Trading Regulations 2008, and the Protection from Harassment Act 1997.

    If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.

    Please treat this also as a formal complaint, and send me a copy of your company complaints procedure.

    Be advised that any further telephone calls from your company will be recorded. (**Even if you don‘t yet have recording equipment!!**)

    Mackenzie Hall have just started chasing my partner regarding a mobile phone debt from 5 and a half years ago. They sent a letter earlier this week asking him to call, which he did. They were incredibly rude and unreasonable. After saying he knew nothing of the debt they gave him 72 hours to look into it. In this time we have seen all these threads and are glad we are not alone! We are sending the prove it letter today by recorded delivery, but already they are calling and texting and sending letters claiming field operatives will be calling in 10 days. He is more than happy to pay the debt if it is real, however we are not prepared to do this without some relevant documentation to prove it and confirm how the figure was reached.

    I have told my partner not to answer there calls and to ignore their letters until they respond to the prove it letter. I hope I am giving good advice, he is very worried about the amount to phone calls and letters they are sending. They are very clever with their words and never say we will be doing.... or this will lead to.....but instead say it could, or it might. They certainly know who to put the fear of god into people.

    Can someone please reassure me we are going about this is the correct manner and someone isn't going come and empty our flat!

    If I was you I'd be very tempted to answer your phone and have a polite conversation with them. See how much they will tell you about the reason for calling, try to get their name. Once they have told you it's for a debt then thank then for their discretion and report them. They should not be discussing even the fact that debts exist with anyone other than the debtor and they shouldn't be harrassing either of you.

    Glad you like the Debitas thread! I go back and re-read it from time to time just to cheer me up (and I've never had dealings with any of these scum!), always has me laughing!

    RAS is right, you need to log the time of every call they make to you - go back through your 'received calls' list on your respective mobiles for starters. You might also be able to get a list of incoming calls for a landline, too, but I don't know...

    Regarding the Bold, it doesn't have a built in voice recorder, and I haven't been able to find an App which does either. However, there are other ways - put them on speakerphone and use an external device to record it, for example. Not exactly practical, I know, but an option...

    Landlines are easier, of course - any recording device with a microphone could work, especially if you have them on speakerphone. If no speakerphone, you'd have to get the mic close enough to the earpiece, which could be entertaining!

    Anyway, even if you can't record, just keeping a log of when they call and what they say is good.

    Relax, they can't send in baliffs without a court order, and from their extreme bullying behaviour it sounds as if they know they haven't a hope of getting one! There is a VERY small chance that they might send a 'doorstep collector' round, but if they do then he has exactly the same legal rights as the paper boy (i.e. none whatsoever), and by law HAS to leave when told to - so IF that happens just tell them to stop trespassing and leave, and if they fail to do so call the police. As I said, from the way they are behaving they are trying to scare you into paying money for a debt the can't actually prove, so you are definitely doing the right thing. :)

    As far as paying off the debt if it is your goes, well, I am usually an advocate of paying off all monies owed to anyone as it is the correct moral thing to do - as long as the debt is with the original creditor, anyway. However, if a debt was passed to a Debt Collection Agency (and thankfully I have never been in that position), all bets would be off and I wouldn't be paying them a penny until they could prove they were legally entitled to it, as that is what they have bought (usually for peanuts) - the right to legally enforce collection of a debt. So if they can't legally enforce it, as the debt was not run up with them originally, I would feel no moral obligation to pay them! ;)

    it would really be best to start you own thread, but as an emergency answer.

    You are quite right - the operative words are "might, may, could" because the possibility is either remote or non-existant.


    You have given your partner the right advice, but I would add:

    1. Logg every call from MH

    2. Send the telephone letter above, regsitered post but put

    "I do not acknowledge any debt to your company" at the top and attach a copy of the OFT guidance to MH on the back.

    3. If either of you answer a phone call, refuse to answer the security questions and tell them that you are recording the call. They will most likely ring off.

    4. Seriously consider a complain to the OFT based their behavipour so far.

    Thank you for the advice. I know I should start a new thread, but can't work out how!!

    I will tell him to carry on ignoring call and letters until they respond to the prove it letter. He is happy to pay the debt, but as he has no documentation on it we only have MH word that the debt exists and I do not trust them for 1 millisecond!

    This company make me so angry, debt is scary enough without having companies like this threatening you into paying. They are vile!

    In the meantime, you are doing the right thing with MH in not trusting them at all, as they have been known to chase people for debts which aren't theirs on a rather regular basis!

    Yes, Chompina, you are going about things in the correct manner.

    Never acknowledge any debt to MacKenzie Hall without written and verifiable proof that the 'debt' is either valid or enforceable.

    And NOBODY is going to come and empty your flat.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
