restocking fee, fair or not.

    not like that all. rather than create a fuss i would have just stuck them up and thought well i got conned on the quality but how many people are really going to tell when they are up on the ceiling. but the missus doesnt see it like that and at the end of the day the seller has said that he hasn't seem them himself as they are shipped direct form china so its all sorted out anyway now as hes going to refund me and its only cost me £18 to send them back to him.

    None of that matters. Under the DSR's you are entitled to return an item for any reason at all. Unless specified otherwise in the sellers return policy you are entitled to your original P&P back, and the costs of the return postage. Sellers are not allowed to charge a re-stocking fee.
    While this may not sound fair, it is the rules when 'remote' selling.

    Within the UK, if I've read it correctly the purchase was made from China, there are no such distance seling regulations for overseas purchases.

    I read it that the item was 'dropshipped' from China, but sold by a UK retailer. The purcahser is entitled to return the item if he so wishes.

    The auction state uk but it seems from what he has said its not plus it was delivered by ems! Nevermind all sorted now as they have agreed a full refund so I'm just down on my postage which I'm fine about
