  • Nationwide have been a shower of b**tards and filed for a CCJ and got it without even presenting the information I sent to them or advising me !!!! :mad:

    Thank You to the original poster, Faye449, and Fermi for his reply on another post which gave a letter template for a letter requesting the Judgement be redetermined.

    Nationwide have just done this to me for an old overdraft which now amounts to £2905.27, despite fact that I am on and paying a DMP with CCCS. :mad:

    Letter & accompanying documents going by 1st Class Recorded Post on Monday...

  • T/phoned CCCS (on Monday), who advised to apply for Redetermination of monthly payments. Email and accompanying budget documents received.


    Sent reply to above Judgement Notice sent to Swindon County Court, reply included a letter requesting Redetermination, copy of CCCS budget, breakdown of CCCS payment and completed N245 form.

    Copy of above reply and covering letter sent to Nationwide BS too.


    Hopefully, Redetermination will come up with sensible figure, as per CCCS budget.

  • Well it's Saturday and have had no response from Swindon County Court or Nationwide BS yet - the latter usually post their letters Thursday so that you get them Saturday to ruin your weekend :(

    Have done budget for Sept / Oct and all items are covered with a v small excess. I anticipate being able to put some money away for Christmas and Car's MOT (Nov) too.

    Hmmm... it's now 2nd October and still no word on the CCJ redetermination request front....

    No doubt something will land on the doormat soon :(

    Hi Chris,

    This is the 1st time ive ever written on one of these threads. Been scanning the internet cause weve got a redetermination hearing Bristol cc later this month and im really worried. Your story is exactly the same as ours : -Nationwide CCJ without us knowing, being advised by CCCS !!

    Just wondered how your getting on ??

    Weve got lots of debts and have been on our DMP since last August. The only company that weve had trouble with has been NW over the credit card debt - they were horrible right from the beginning and they are by no means our largest debt.

    I'm worried that the only reason they have taken this stance is because weve got our mortgage with them PLEASE CAN ANYONE GIVE ME THEIR THOUGHTS ON THIS. We have always paid our mortgage on time and have NEVER had arrears also we havent missed any payments on our DMP.

    Any advise gratefully received and good luck Chris.

    Hi Mandy

    I get the impression that Nationwide (or "Nationsnide" as I now like to think of them :D) are basically looking to clear their uncollected debt portfolio and bolster their balance sheet.

    At the moment, savings receipts for the likes of Nationwide are low due to low interest rates and recession - basically, people wont save if they've got bills and debts to pay and the "return" on money in a account is so low - I think one of Nationwide's accounts pays the princely sum of 0.1% interest per year !!

    I got a reply from Swindon County Court today stating Redetermination hearing to be held on Merseyside, time, date and location to be confirmed in due course.I am quite pleased with this as I was getting worried that I would default on the CCJ :eek:

    I'm sorry you are getting grief off Nationsnide as I statrted banking with them about 15 years ago and they were good to be with. Now, they are just plain horrible. I think they have gone down the CCJ route as the £12.00 a month they're getting via CCCS DMP really gets up their nose...well tough!

    No news at present re. redetermination.

    Had to get brakes fixed on car on Monday - £115.00 - but managed to do this by drawing upon savings and this month's budget :).

    Still on track to stay within this month's budget.

    Hi Chris,

    We had our redetermination hearing - very nerve wracking. Came out with the right result tho :) the judge wasnt at all impressed with NW. They asked for a charging order against our house if he didnt agree to keep the payments the same as the CCJ ordered. The judge said that there was no way he was agreeing to this and the only reason they were asking was to get "a jump" on our other creditors which he said was wrong. He put the payment back to our original DMP figure :j. Were really pleased that NW wont be getting the lions share of our DMP any more !!!

    Well Done on the redetermination hearing. It isencouraging that the Judge set the amount at a reasonable level and "saw through" what Nationwide (or Nationsnide as I now call them :D) were trying t do i.e.bully their way to a better / increasing amount.

    I hope that the Judge that looks at my CCJ is equally understanding as Nationwide want about £160.00 / month :eek: which is ridiculous as my whole DMP is £61.00 / month !!!!
