Hip searches expire after 6mths?

hi

i am thinking of putting an offer in on a house, it has been on the market for over 6 months now, and after speaking to a solicitor i have been told that the searches on the HIP for the property i am interested in, will now be out of date, because its over 6 months old.

and becasue my lender requires upto date searches i have to now pay for them, which is going to cost me about £180.00.

can i ask the vendor to pay for another HIP before i put my offer in.

im not a big fan of HIPS and this is another reason that just proves they are a waste of time...

    You can try. Why not put your offer in saying that it is on the condition that the vendor pays for up to date HIPS

    Why should they? Prior to Hips being implemented you would have had to pay for your own searches anyway.

    The Vendor has fullfilled their obligation by supplying a HIP, the fact that the searches are more than 6 months old is irrelevant to them and they are not obliged to re-do the searches.
    My home is usually the House Buying, Renting and Selling Forum where I can be found trying to (sometimes unsucessfully) prove that not all Estate Agents are crooks. With 20 years experience of Sales/Lettings and having bought and sold many of my own properties I've usually got something to say ;)

  • GUtted to read this. Just paid (stupidly I accept) an arm and a leg for my HIPS safe in the knowledge that someone else was paying for the searches ont he propoerty I want top buy......since its been on the marklet two years I guess not then.........aargrggghhhh

    This is bo11ocks, if they want to sell the house(the law has changed remember) they should keep everything up to date. If the sale can go ahead without the update then it's a risk you take. There may be a planning app gone in that doesn't show up but I am sure you can talk to the local plaanning dep't.

    Unless the regulations change then they don't 'need' to keep the searches up to date.

    IME Solicitors are applying for searches when HIP's are only a few weeks old anyway so most Purchasers end up paying for the same searches again.

    IME Solicitors are applying for searches when HIP's are only a few weeks old anyway so most Purchasers end up paying for the same searches again.

    This is what my solicitor has just done. I didn't know that they would be doing this though , as the quote I received before I had found a property mentioned the cost of searches were only if they were required.

    I have just emailed my solicitor to ask why they are doing them again, but I'm sure they will say that it is too late to stop them, so I will have to pay for them again. :mad:

    I would be having a stern word with the Solicitor and asking him why he didn't use the searches included in the HIP !

    It would be very irresponsible for a solicitor to accept the searches in a HIP. The solicitor represents the buyer and if the search that came with a HIP was defective in any way its the conveyancing solicitor who would be first in the firing line
