If the payment bounced- surely you'd have it back- the fact that you have not got it means its somewhere, and I'd place bets on it being with the seller.

Tell the seller you have contacted paypal who say the payment has not bounced- see what they say.

Mention the rules as stated by ebay, see what they say, then put through a claim, see if they change their mind.

I would certainly not send this seller a cheque. You have no protection at all if you do this.

I assume that his Paypal account is limited which is not a good sign.

As has been said do nothing as you have already sent a payment and start a claim in 7 days if nothing has arrived.

I got a reply from him today, he said that he cant refund me because hes completely locked out of his paypal account. Ive NEVER heard of this before, how will he pay his ebay charges?

Thanks everyone for all the replies, looks like I will have to do a item not recieved to get my money back.

It can happen when people get their accounts limited, paypal stop you from sending money and so many people think they can’t refund but they usually can.

i doubt he's been completely locked out though or paypal would be bouncing back payments, they can’t close an account and keep accepting payments to that account, that’s theft....mind you i've heard worse about paypal.

Seriously though, he's probably just been hit with a paypal account limitation and doesn't know what to do, i'd open the dispute just to get things going it will make it easier for him to refund if he's having problems or failing that if he doesn't respond you'll get your money back by default.

The account limitation might be down to misconduct on his part but i wouldn't jump to conclusions paypal routinely freeze accounts even when people do nothing wrong so it's hardly evidence of wrong doing on his part.
