Test driving a car - no tax/insurance

Hi everyone,

I am trying to sell a car at the moment but it has no tax and I'm not insured on it. Someone is coming to look at the car tonight and I have said a test drive won't be possible because of the above reasons but they are insisting on taking the car out.

I can understand why they are saying this as I wouldn't buy a car that I wasn't allowed to drive first. They have suggested they just take it on a drive and 'chance it'. I have said though if they were pulled over then I would get in trouble for letting them drive an uninsured/taxed car but they say its just them that will get in trouble. I am also worried if they crashed it there would be no insurance. They keep trying to tell me that their insurance covers it.

So my questions are:

If they were caught driving it who would get in trouble?

Is there any way they will be able to test drive it without breaking the law?

Thanks everyone. I'm sure they're just saying it'll be fine because they want to test drive it but I thought I'd check on here about the legal side of things.

    Regardless of insurance, if it isn't taxed then that is solely your responsibility and for that alone I would advise not allowing a test drive.

    Exactly as I thought then Andy. Buyer willing to lie to get a test drive. Doesn't bode well for his character and how much I am giong to haggle!

    So that means for people to test drive it I'll have to get insured and get taxed on it. Damn selling a car isn't fun. First one I've sold and I'm having to throw pound after pound at it.

    Their insurance would cover it but only on a third party basis. So if he wrote off or even damaged your car - then tough, he would walk away.

    Ring him back and tell him again. he then has a choice to view the car or not

    Like Landyandy says, the tax is all your responsibility.

    Just turn it on on the drive, anyone who knows about cars will have an ear for it and if he doesnt then he should have brought someone who has.

    Would his insurance not only count if I was insured on the car too? I thought fully comp only counts if someone is insured on that specific car?

    I will make sure I stand my ground. I am not getting a driving offence for someone else. Getting insured is hard enough at my age.

    Depends on what it says in his insurance policy.
  • out of interest what car is it, i think without people being able to drive it you will get a lower price, i would never buy a car without taking it for a spin

    E2A: hewhoisnot, Its this car. I wouldn't buy a car without test driving it either to be honest but I'm sure the right buyer will come along soon :)

    Ideally you need to insure the car for any driver and obviously it must be taxed before being allowed on the public roads.

    All of this should have been carried out before advertising the car.

    Do not allow anyone to drive it without it being fully road legal.

    let him test drive it on your driveway, turn it on, rev it a bit, that'll do!
    thats what i did for my motorbike and that was 3 years ago
    Target Savings by end 2009: 20,000
    current savings: 20,500 (target hit yippee!)
    Debts: 8000 (student loan so doesnt count)

    new target savings by Feb 2010: 30,000
