Xbox 360 game damaged

I recently bought an Xbox 360 for the first time and bought an extra couple of games. When playing a game yesterday the Xbox was in the upright position to make it easier, but I wanted to change game so put the Xbox in the horizontal position and when I did they was an awful rattling noise so I quickly ejected the disc, examined it and noticed a circular scratch around the whole center of the disc. I tried to put it back in the Xbox but received disc read error or something similar. I am absolutely gutted as I had just bought this game and was wondering whether this was a common problem with the Xbox and whether I have any rights to return the game as damaged? I look forward to hearing your views..

you are not meant to move the 360 with a game in the drive

Have to agree with custardy, if it was merely a fault that wasn't caused by user intervention you'd probably have a case. But since you went against the warnings in the manual I don't think there's much you can do. The game isn't faulty so no refund there, and the Xbox was used incorrectly so no refund through that route either."She is quite the oddball. M$ do a disc swap programme on a small selection of games

Theres 2 options, you can try the link custardy provided or you learn the lesson and dont do it again and buy another copy of the game0

Thanks for your replies, I must admit I didn't read the manual fully so if it said that I didn't realise. I know my PS2 had no problems with this but I guess I have learnt my lesson and won't do it again that's for sure.0

Don't give up yet, my son had a similar problem with a disc which would no longer play, we took it to a local games shop, Chips, and they repaired it for £2.99. It was put into a cleaning machine which cleaned it with a variety of different sponges, well that's what it looked like, anyway it took a couple of minutes and disc is now perfect.0 -
There is a fault with XBOX 360's in that what you've mentioned happens quite regularly. Although in your case, moving it was what caused the problem, others have had their discs destroyed through only vibrations caused by lorries going past their houses.
This was on watchdog several months ago but Microsoft wouldn't admit liability. The best thing to do is to try and get the discs buffed. They also did this on Watchdog and it worked.Northern Ireland club member No 382 :j0 -
Like the above poster said it was on Watchdog a few months ago, they recommended going to any Blockbuster shop as they have machines to clean / repair discs. I went when I had the same thing happen and they charge about £2.50 a disc, unfortunately they could not repair mine as the laser burn was to deep0

Ah yes, my brother in law mentioned something about it being mentioned on Watchdog but he couldn't remember how it was resolved. Do you happen to know where I can get the disc treated?0

Yeah i agree with above dont panic.
You can get the game repaired for a couple of quid but did you know with most of the new games you are able to install them to the harddrive and it only need the CD to validate that you have the game still.
When you put they game in go to it on the dashboard and i think it button "Y" and it will give you the option to install it.
That way you dont need the noisy Cd drive running all the time reducing the chance of damaging the CD.
You may require the lastest Xbox software which is a free update if you contect to Xbox live.
