One more question, my mom will look to take my stepfather of the deeds as he is now deceased. For the restrictions to come off when/if she sells the house does there need to be joint owners on the deeds?0

It is different when a joint owner has deceased.
Have a look around post #2417 (page 121) as Land Registry Rep explains this a bit more.0 -

Thanks for all your julep and support it's appreciated
Next avenue may be for me to look st purchasing it so in my name only Don't know how to about that or if I can and the cheapest option
What if you had some rich friends or relatives who purchased the house from you, then sold it on your behalf? Would that work?
Ignore me if I'm not making sense… don't get much sleep these days… 4 and a half years of litigation… have reached the High Court now…:(

We are still waiting for the final plug pulled email we feel stuck with a house we can't sell which is ironic as the people who get these orders are effectively going no where really just stop us going anywhere too !
In my case, the person who has the CO on my property deliberately caused the sale to collapse, thereby preventing me from paying him…Then he kept threatening to make appellations for OFS… it's been a nightmare!!

You just need a 3rd party who has a good solicitor and understands the rules which are in black and white… They buy from you and then sell to your waiting buyer… it all seems to easy, so I'm probably wrong! D450 -
I Can't imagine the stress. It's a mine field if I'm honest I wish I hadn't started the process but don't want to throw towel in st this late stage. Not to mention I am already a grand out of pocket plus the solicitors fees bill we will have if it falls through. If the one we have goes for an OFS at any point she would never get her money anyway now she has done what she has done and the other restrictions take
Priority anyway she will never get her money but some people are just vile and vindictive this is a family member for us which makes it worse0 -
Our solicitor understands that the wording needs adhering to and is on board I even have an email from LR confirming g over reaching g still not enough it would seem0
