Shoes 'broken' after a couple months wear

I bought some mens shoes, £90 they were. I have worn them quite a lot since purchase in May this year but now I notice heel has started to come off...

I could try and glue it back on but you don't really expect to do this with a £90 pair of shoes do you? and also it could happen again...

So my question is, am I entitled to a refund/exchange? even though they are worn? I have my receipt. How long is a pair of shoes expected to last?

Everyones opinion is the most important.....no wonder nothing is ever agreed on.
  • where did you purchase them from?

I recently returned a pair to M&S that i purchased in may (ladies basic pumps) and was told that they were not for wearing:rotfl:

then she corrected herself and said everyday wear - anyway, they would not refund me, but gave me a credit note, which i was quite happy with as i only really wanted them replaced.

She said there policy was that shoes should have 6 months wear - so in answer i would have thought you could at least try.

£90  for a pair of shoes that last only a couple of months.

Take them back, see what they say but i would say an exchange at lease but a refund is also likely, depends on what you want. TBH i would even expect a £30 pair of shoes to last more that 2 months.
stand your ground. Goods not fit for the purpose.
Be nice though - you get a lot further that way

They're expected to last longer than 2 months that's for sure. Though that does tend to depend upon what you've been doing in them. General walking, yes longer than 2 months. Walking along the beach in and out the surf with the shoes on, not that long after the salt has got in there.

I would suggest a visit back to the place you purchased them from, see what they say, but generally assuming just walking then yes shoes are expected to last longer than 2 months.

All of that said, you may do better just visiting a shoe repairers: http://www.timpson.co.uk/highstreet-stores/locations.asp

the point i was making has been made by ABH above,
yes generally they should last longer than 2 months but if your not using something they way they are meant to be used then they may not last very long, if the shoes still look like new you have a good chance of a refund/replacement but if they look lke they have been to vietnam and back you can forget it...........

I purchased them from Schuh. I have just looked on their website, on the product page for the shoes I have there's 2 reviews. BOTH reviews mention the heel came off.

The shoes do not look like new at all now. They look worn, the leather has worn a lot....BUT I remember when I purchased them, the shoe on display was very worn too, was the reason why I chose it. When they brought out my size I thought they'd brought out the wrong shoe because it wasn't worn and looked different so I assume they wear very easily.

The law requires that goods purchased must be as described, fit for purpose and of satisfactory quality. Goods are of satisfactory quality if they reach the standard that a reasonable person would regard as satisfactory, taking into account the price and any description.

So, if for example you bought a pair of shoes costing £20, how long would you reasonably expect them to last? (bearing in mind that a pair of 'everyday' shoes can be expected to be worn every day - as opposed to something like a pair of patent leather dress shoes designed to be worn indoors with a dinner suit on special occasions)? Say about 2 mths..?

So if you spent £90, I would imagine they are supposed to be of superior quality to a £20 pair, so reasonably, I would suggest you could expect to get at least 6mths normal wear out of them, maybe 12 mths.

£90 is a lot of money for a pair of shoes.
If you will the end, you must will the means.

When you return to the shop point out that goods sold must be durable, they must last a reasonable amount of time under the use they were intended for. Two months for £90 shoes isn't a reasonable time, they should last longer than that. You should get a free repair at least as I see it...

Well in that case then, print off the webpage reviews so you've got some proof that there's a fault in those particular shoes. They can't deny it anyway, as long as the purchase is under 6 months old then there's a reverse burden of proof under the Sales Of Goods Act 1979 that the items must have an inherent fault, or you could point out that they're supposed to be durable but aren't.

So visit the shop, inform them of your problem and ask them if they would accept whatever remedy it is you've got in mind, it could be: repair, replacement or refund. If they deny you any of those then give them whichever of the weapons you have at your disposal ;)

Here's the Reverse Burdon Of Proof:
