Getting a refund... advice please.

Hi all,
I bought a camera from Amazon.co.uk the other day using my credit card. The camera is absolutely rubbish, the quality of the images are a joke. So I want to return it.

The problem is that Amazon sold it through a third party, so I have to deal with them. If they refuse to take the camera back, will my credit card company be able to help?

    Can't help you with anything to do with the credit card guarantee, but would be interested to know what camera it is that you bought and did you look at the other customer reviews before purchasing?

    Yes, so long as you spent more than a hundred pounds your CC provider is liable in the same way as the merchant who sold you the camera. If the camera is not "of merchantable quality" and suitable for the purpose for which it was intended, and broadly as described on the web page where you bought it, then you have a right to a refund. Should the merchant fail to provide that refund, then your credit card company should help.

    So contact the vendor and give them an opportunity to solve the problem, but copy your letter to your credit card company. And read up on the Sale of Goods Act.

    unless the camera is faulty in some way, I doubt you have any recourse with anyone.

    I doubt your credit card company would be able to help since there is a third party involved in the transaction, i.e. Amazon Payments. Section 75 of the Consumer Credit Act only covers direct transations between you and the seller. I've encountered this problem using Google Checkout.

    You're covered by the Distance Selling Regulations for 7 days after delivery.
    Amazon provide more info in their help pages.

    Well the good news is that I returned the product because I was unhappy with the performance and got a full refund.

    I then went an spent four times as much on a new one :-(

    The good news is that it is simply AWESOME. The quality is absolutely amazing.

    original camcorder I returned was the Samsung VP-MX20.
    Absolute rubbish. Didn't focus right, blocky image. YUK.

    The new on is a Canon HD HG 10. WOW is all I can say about this one.
  • Hi, on a related note I just wondered where do i stand as I bought a camera in jessops and think the image quality is very poor too for what I paid for it!

    Could I take it back to the shop for a refund or are the rules different for high st stores to online merchants?

    You won't be covered under the "distance" selling regulations if you bought it in a shop, so yes it's different.

    It's different because as the poster above says, you get a chance to examine the item in the shop before you buy it whereas you don't get that opportunity when buying from on-line.

    As far as the Sales of goods act goes, you are probably on dodgy ground with quality.
    If it didn't take pictures at all you could certinaly claim if wasn't fit for purpose.
    If you simply don't like the image quality then that more difficult because it still performs the function of taking pictures.
    I'd say you are on dodgy ground, because you had the chance to see the image quality up front.
    However if you want to buy somethign more expensive and it's in good condition then I would have thought that they would exchange it for you.

    I think you should be able to take it back to them Purple Spider. How long ago did you get it? The sooner you take it back the better.
