T-Mobile BB Curve - No data services except in wifi

Hi all,
Up til 2 weeks ago, I'd had only nominal issues with my curve 8900 & internet/email etc, but now I cannot access email, internet or apps unless I am connected to the wifi at home.
Also the phone will not send or recieve mms messages at all.
I've spoken to T-Mo CS a few times (not much use) but finally they put me through to the proper UK tech support guys & they determined it is a hardware problem.
I've to take my handset in to the nearest store to be sent away to Rim for repair/replace and they'll apparently give me a handset to use til it is returned.
My concern is, after lots of googling, I see a lot of folk (in USA and UK) having similar issues that couldn't be rectified.
I've only had my curve 4 months, but still I'm concerned that if the issue isn't resolved T-Mo will leave me stuck with a handset that is only good for calls or sms when I leave the house.
Is there any grounds/allowance for me to change to a different handset if this is the case?
If not, would I need a different sim to use a different handset (non blackberry) and would T-Mo let me change tariff off of a BB one?
I spoke to CS again today & the girl mentioned something about the sale of goods act & how I could get it replaced within 6 months of having it?
Any comments or advice appreciated.

Ignore her when she says about "getting it replaced". Ive worked for T-mobile and I'm REDE (Repairs and Exchanges) trained, They will most likely repair it under the Sales of Good Act, Very rarely will they exchange it, Unless its been repaired 3 or more times with the same fault.0

My big concern is it may just be an issue with that particular phone?
Taking it to my local store tomorrow, so I'll see how I get on0
