T-Mobile N96 Problems

Hi
Just looking for some advice before I call T-Mobile back:
I purchased a Nokia N96 arounf 4 months ago on an 18 month contract
I have had a number of issues with the handset primarily the screen developing a small flaw (it wasn't dropped) and it freezes and switches off A LOT
I contacted Nokia (as T Mobile could offer no technical assistance beyond 'buy a new battery) who advised me the freezing etc is down to the firmware. They acknowledge these issues and state they have upgraded the firmware several times. I cannot access this firmware as I have a branded T-Mobile phone. Nokia tell me the firmware updates are provided to all operators and it is up to them to customise and release to there customer base.
Before I call T-Mobile (who will not provide the new firmware) do I have a case to cancel my contract since I have a sub-standard handset that they refuse to upgrade?

What version firmware do you have my N96 is TMobile branded and have been ablt to upgrade to version 12 about a month ago. I had to update via the PC is wasn't available on the update overair option.0

Sorry forgot to add I got my N96 in January/February and not had any problems with it at all. Have you tried posting on Nokia Discussions forum as there are a lot of helpful people on there.0

i had problems with the n95 and i had it repaired and it was a electrical fault...i had the same problems with it.
