Vodafone rip off help pls

Hiya all this is my first ever post so i hope i do it right,

My hubby has been with vodafone for years & his contract was due up for renewal 2 months ago he was on a £40 per month contract sa he had quit a jazzy mobile, he explained to the woman who rang him he didnt want a new phone but loves the minutes and msgs and the stop the clock (which isnt availble anymore on new contracts) so asked could he continue to use his old phone with a reduced rate on a 12 months contract & he was offered it for £20 he said ok & we were very happy,

Well the last 2 payments have been £40+ but as we were in turkey for a while we thought the over billing was due to that, we called them today to be told he is on a £40 a month contract he must of recieved a new phone & theres nothing they can do about it as theres no notes on the account, twice they said a manager would call us back & hasnt, & twice they have said call back in 9 months when ur allowed an upgrade????

we got no paperwork thru when this contract was took out, where do we stand, were both sooo confused, help thanks Cherie

    Explain to them you have NOT asked for a new phone, and that they sent you one without your consent. By doing so they have acted unlawfully. Regardless, you have not receieved any phone, and therefore it is not your concern.

    Tell them you did not agree to any new contract containing a new phone, and therefore they should terminate it immediately. You should then explain that as you are out of contract, you will be joining another network due to the inconvenience caused by this fiasco unless they can reinstate the offer that you first agreed to, along with credit into the account amounting to the difference between the old and new contract.

    Also tell them that your are perturbed and very close to refering this matter to Oftel.

    Try posting this issue in the Vodafone complaints/Vodafone retentions thread for the attention of Lee/Kirsty, or try the Vodafone forums.
    Also keep phoning 191 and keep asking for the manager.

    Everytime you ring Vodafone at the end of the call ask the operator to put a note on you file to confirm what they have said.

    If you had a new phone you should have signed for it. Ask for a copy of the delivery note as you have not signed for it.

    If they have not sent a phone how can you be on the £40 contract? So ask them to explain. Ask them the name of the operator that agreeded the so called £40 deal?
    Just keep ringing and say you don't understand, always asked to be put through to a UK call center.

    AFTER EVERY CALL REMEMBER TO TELL THEM TO NOTE YOUR ACCOUNT!!!!

    Unfortunately, this is becoming quite a common occurence with vodafone. I went through this fiasco a couple of weeks ago, and it barely got resolved after speaking to 10 different staff members and 2 managers. I asked them all to note the calls on the system, but they like being selective. :rolleyes:

    Apparently the phone that I "did not ask for was delivered to an address some 200 plus miles away from me, but guess who was going toi be billed for the delivery...

    I have just had £25 credit back after £9 last mth this is all because they say I have had a TV pack etc. She went straight back to the notes and read what was put last mth, money given back no problem.

    If you find notes are not being put on your account tell them such and ask them to read back what they have put( you can tell if they are reading or making it up) ask for names and contact emails, do anything to make them accountable for what they have said. It may be a pain but its your money.
