Car Crash URGENT help needed!!

Hi new poster so please be easy on me.
Ive just had my brother on the phone he was driving some friends home last week when he lost control of his car due to heavy rain and crached into a ditch at low speed. The damage to the car is minor and as such he has arranged to have this fixed by a garage rather than through his insuarance company as his excess is very high (£700).
However he has now been contacted by two of his "friends" who have said they are going to put a PI claim in against him. Their claims are 100% bogus - due to the speed of the impact and the characters in question (I am not looking to get into the validity of PI claims and how seriously they affect people, as I know first hand claimants can sometimes suffer hugely, and the money awarded is rarely compensation for the often ongoing pain that is inflicted )
My question is this: What is the best way to proceed? Is he going to have to claim against his insuarance to fund his "friends" bogus claims, or should he fight their fraudulant claims? Is there anyone fighting the drivers corner? Or is it just the endless stream of Americanised insuarance companies urging us to sue our Nan's etc?
Looking for some genuine help here guys - thank you

Not really sure I can advise you, plenty of peeps on here that can and will be along in a mo!
If it were me........ I would call their bluff and say Im going through my insurance now and they will be in contact with you and they will have to see the insurance doctors etc......
I cant believe so called "friends" would do this, but I suppose its greed greed greed!
Good luck, im sure someone will be along in a mo

Thanks, so does that mean he will be forced to claim on his insuarance - the damage to the car is less than £50 the excess £700?0

The things is they are likely to pursue PI so it best to get onto insurers and they will sort all of that out with him. You will prob find that the "friends" back off and dont pursue it after you say you now going through the insurers.
I have a feeling that you dont have to pay theexcess if you dont have the work done andit does seem minimal - but you have to report it to them! Its up to him whether he has the repairs done he does not have to but best cover yourself!
hope this helps

They will not back off if you say your going to the insurers.
You do not normally have to pay your excess if your not claiming for the repairs to your own vehicle, so no excess0 -

The no win solicitors that are handling it for them will only normally deal with claims where the other person has Insurance (Apart from MIB claims)as they know they will get their fees which is the most important thing for them, oh and the compensation for their customers.0

I totally agree I cant imagine doing it to a friend of mine, especially if I wasnt actually injured. They have clearly been watching too many adverts in between the Jeremy Kyle show... I guess his premiums will be screwed, just seems unfair really......dramaqueen1973 wrote: »Hmm i think your right there - still have this thing in my head which says friends stick by friends - got to learn the hard way it dont happen in real life and they can stitch you up at anytime:eek:

In this instance the fact that my brother has insurance looks like it will count against him then! Oh the irony0 -

It's not irony, it's what insurance is for.0
