Argos' empty promise

I bought a hairdryer from Argos in Colchester on 08/07/2009. After opening the packaging and used the hairdryer once, I found the quality of the product unsatisfactory and I wanted to swap for another one with the store. When I tried to return my purchase to Argos on 18/07/09, my request was flatly rejected by the manager, who quoted the t&c at the back of my receipt: "...simply return your item unused, in the original undamaged packaging, in a saleable condition with the receipt, to any Argos store within 30 days of purchase..." But surely, if I did not use the hairdryer, I would not have been able to say that the quality of the item is unsatisfactory?
I called the Argos customer helpline on 19/07/2009 and got exactly the same answer. The emphasis is on UNUSED. The advisor there further stressed that it does not matter whether the product was used once or ten times. Once used, it cannot be returned.

Argos' 30-day promise means absolutely nothing. BEWARE!!

You're getting annoyed because they followed their returns policy?
    Squirrel!
If I tell you who I work for, I'm not allowed to help you. If I don't say, then I can help you with questions and fixing products. Regardless, there's still no secret EU law.

It's not a 'try before you buy' service. The 30 day money back guarantee is offered in addition to your statutory rights and they are not legally required to return unwanted items. They will only return what they can resell, so if it's not in a saleable condition they won't accept it.

Unless the hairdryer was faulty in anyway, you have no legal right to a refund or replacement.

    Why was it unsatisfactory?

If it was because of a fault then a refund is due, if it's because you "don't like it" then they are correct. Only mail order goods get the chance to try out due to the Distance selling laws...

    Hello all,

The hairdryer in question is of Revlon brand, normally retailed at £18.59. It's not an Argos value product. I have had 2000w hairdryer before of other brands, they all had more powerful performance than this one. Am I wrong to have any expectation?

I used it only once. I did not intend to TRY it. I'm a bona fide customer, not someone sent to test the products on the market.

You possibly should have seen the face of the store manager. Sheer rudeness!

Being honest they are not being rude, Maybe you didnt mean to try it, But you opened it. They are following policy and you are kicking up a stink for nothing. Spitting out the dummy because you didnt get your own way. Grow up.

I thought the very purpose of this website is to question the essence of policy of many big companies. Did I miss any small prints?
